  1                      A bill to be entitled

  2         An act relating to child support enforcement;

  3         amending s. 409.2557, F.S.; providing that

  4         certain child enforcement demonstration

  5         projects are no longer demonstration projects,

  6         but local solutions to providing such

  7         enforcement; providing duties and

  8         responsibilities of the Department of Revenue

  9         regarding funding such child support

10         enforcement services; providing an effective

11         date.

13  Be It Enacted by the Legislature of the State of Florida:

14  

15         Section 1.  Subsection (2) of section 409.2557, Florida

16  Statutes, is amended to read:

17         409.2557  State agency for administering child support

18  enforcement program.--

19         (2)(a)  The department in its capacity as the state

20  Title IV-D agency shall have the authority to take actions

21  necessary to carry out the public policy of ensuring that

22  children are maintained from the resources of their parents to

23  the extent possible.  The department's authority shall

24  include, but not be limited to, the establishment of paternity

25  or support obligations, as well as the modification,

26  enforcement, and collection of support obligations.

27         (b)  Notwithstanding the provisions of chapter 85-178,

28  Laws of Florida, any child support enforcement demonstration

29  projects created under that law and still in operation on

30  January 15, 2003, are not considered demonstration projects

31  but are a local solution to providing child support

 1  enforcement services in those counties. Therefore, the

 2  Department of Revenue shall continue to fund those operations

 3  under a cost reimbursement contract with the local agencies

 4  responsible for the delivery, administration, and management

 5  of comprehensive child support enforcement activities in those

 6  counties.

 7         (c)  Whether services are provided directly by the

 8  department or by contractual agreement with a local agency,

 9  the department shall retain responsibility for ensuring that

10  all services required by the state Title IV-D program are

11  provided in accordance with applicable federal and state laws.

12         Section 2.  This act shall take effect upon becoming a

13  law.
