  1                      A bill to be entitled

  2         An act relating to public records; amending s.

  3         440.185, F.S.; reenacting the provision

  4         exempting from public-records requirements

  5         information in certain reports of injury or

  6         illness which would identify an ill or injured

  7         employee; removing the repeal of that provision

  8         which was scheduled under the Open Government

  9         Sunset Review Act of 1995; providing an

10         effective date.

12  Be It Enacted by the Legislature of the State of Florida:

13  

14         Section 1.  Notwithstanding the repeal scheduled on

15  October 2, 2003, under the Open Government Sunset Review Act

16  of 1995, subsection (11) of section 440.185, Florida Statutes,

17  is reenacted and amended to read:

18         440.185  Notice of injury or death; reports; penalties

19  for violations.--

20         (11)  Any information in a report of injury or illness

21  filed pursuant to this section that would identify an ill or

22  injured employee is confidential and exempt from the

23  provisions of s. 119.07(1) and s. 24(a), Art. I of the State

24  Constitution. This subsection is subject to the Open

25  Government Sunset Review Act of 1995 in accordance with s.

26  119.15, and shall stand repealed on October 2, 2003, unless

27  reviewed and saved from repeal through reenactment by the

28  Legislature.

29         Section 2.  This act shall take effect July 1, 2003.

 3    Reenacts an exemption from the public-records law which
      is provided for information that would identify an ill or
 4    injured employee, which information is included in a
      report of injury or illness filed under s. 440.185, F.S.,
