18 Section 42. Paragraph (a) of subsection (4) of section
19 464.0205, Florida Statutes, is amended to read:
20 464.0205 Retired volunteer nurse certificate.--
21 (4) A retired volunteer nurse receiving certification
22 from the board shall:
23 (a) Work under the direct supervision of the director
24 of a county health department, a physician working under a
25 limited license issued pursuant to s. 458.315 458.317 or s.
26 459.0075, a physician licensed under chapter 458 or chapter
27 459, an advanced registered nurse practitioner certified under
28 s. 464.012, or a registered nurse licensed under s. 464.008 or
29 s. 464.009.
30 Section 43. Subsections (1) and (5) of section
31 464.203, Florida Statutes, are amended and subsections (8) and

1 (9) are added to that section, to read:
2 464.203 Certified nursing assistants; certification
3 requirement.--
4 (1) The board shall issue a certificate to practice as
5 a certified nursing assistant to any person who demonstrates a
6 minimum competency to read and write and successfully passes
7 the required statewide criminal screening through the
8 Department of Law Enforcement, including Level I screening
9 pursuant to chapter 435, or, if the applicant has not
10 maintained continuous residency within the state for 5 years
11 immediately preceding the date of application, Level II
12 screening which includes a fingerprint check through the
13 Department of Law Enforcement and the Federal Bureau of
14 Investigation pursuant to chapter 435, Level I or Level II
15 screening pursuant to s. 400.215 and meets one of the
16 following requirements:
17 (a) Has successfully completed an approved training
18 program and achieved a minimum score, established by rule of
19 the board, on the nursing assistant competency examination,
20 which consists of a written portion and skills-demonstration
21 portion approved by the board and administered at a site and
22 by personnel approved by the department.
23 (b) Has achieved a minimum score, established by rule
24 of the board, on the nursing assistant competency examination,
25 which consists of a written portion and skills-demonstration
26 portion, approved by the board and administered at a site and
27 by personnel approved by the department and:
28 1. Has a high school diploma, or its equivalent; or
29 2. Is at least 18 years of age.
30 (c) Is currently certified in another state; is listed
31 on that state's certified nursing assistant registry; and has

1 not been found to have committed abuse, neglect, or
2 exploitation in that state.
3 (d) Has completed the curriculum developed under the
4 Enterprise Florida Jobs and Education Partnership Grant and
5 achieved a minimum score, established by rule of the board, on
6 the nursing assistant competency examination, which consists
7 of a written portion and skills-demonstration portion,
8 approved by the board and administered at a site and by
9 personnel approved by the department.
10 (5) Certification as a nursing assistant, in
11 accordance with this part, may be renewed continues in effect
12 until such time as the nursing assistant allows a period of 24
13 consecutive months to pass during which period the nursing
14 assistant fails to perform any nursing-related services for
15 monetary compensation. When a nursing assistant fails to
16 perform any nursing-related services for monetary compensation
17 for a period of 24 consecutive months, the nursing assistant
18 must complete a new training and competency evaluation program
19 or a new competency evaluation program.
20 (8) The department shall renew a certificate upon
21 receipt of the renewal application and imposition of a fee of
22 not less than $20 and not more than $50 biennially. The
23 department shall adopt rules establishing a procedure for the
24 biennial renewal of certificates. Any certificate not renewed
25 by July 1, 2005, shall be void.
26 (9) Notwithstanding any provision of law to the
27 contrary, any entity required to conduct a Level I or Level II
28 screening, pursuant to chapter 435, is exempt from rescreening
29 any certified nursing assistant upon employment if the
30 screening date on the certificate issued by the board is
31 within the last 12 months, the certified nursing assistant has

1 not been unemployed for more than 180 days, and the nursing
2 assistant attests under penalty of perjury to not having been
3 convicted of a disqualifying offense since the completion of
4 such screening.
