11  Senator Peaden moved the following amendment:

13         Senate Amendment (with title amendment) 
14         On page 75, between lines 21 and 22,
15  
16  insert:  
17         Section 54.  Subsection (3) of section 491.0147,
18  Florida Statutes, is amended to read:
19         491.0147  Confidentiality and privileged
20  communications.--Any communication between any person licensed
21  or certified under this chapter and her or his patient or
22  client shall be confidential. This secrecy may be waived under
23  the following conditions:
24         (3)(a)  When there is a clear and immediate probability
25  of physical harm to the patient or client, to other
26  individuals, or to society and the person licensed or
27  certified under this chapter communicates the information only
28  to the potential victim, appropriate family member, or law
29  enforcement or other appropriate authorities.
30         (b)  There shall be no civil or criminal liability
31  arising from the disclosure of otherwise confidential
