14 On page 79, between lines 3 and 4,

16 insert:
17 Section 56. Paragraph (a) of subsection (4) of section
18 766.314, Florida Statutes, is amended to read:
19 766.314 Assessment; plan of operation.--
20 (4) The following persons and entities shall pay into
21 the association an initial assessment in accordance with the
22 plan of operation:
23 (a) On or before October 1, 1988, each hospital
24 licensed under chapter 395 shall pay an initial assessment of
25 $50 per infant delivered in the hospital during the prior
26 calendar year, as reported to the Agency for Health Care
27 Administration; provided, however, that a hospital owned or
28 operated by the state or a county, special taxing district, or
29 other political subdivision of the state shall not be required
30 to pay the initial assessment or any assessment required by
31 subsection (5). The term "infant delivered" includes live

1 births and not stillbirths, but the term does not include
2 infants delivered by employees or agents of the Board of
3 Regents, or those born in a teaching hospital as defined in s.
4 408.07, or those born in a family practice teaching hospital
5 designated pursuant to s. 395.806 which was exempted by the
6 association from assessments for fiscal years 1997-1998
7 through 2001-2002. The initial assessment and any assessment
8 imposed pursuant to subsection (5) may not include any infant
9 born to a charity patient (as defined by rule of the Agency
10 for Health Care Administration) or born to a patient for whom
11 the hospital receives Medicaid reimbursement, if the sum of
12 the annual charges for charity patients plus the annual
13 Medicaid contractuals of the hospital exceeds 10 percent of
14 the total annual gross operating revenues of the hospital.
15 The hospital is responsible for documenting, to the
16 satisfaction of the association, the exclusion of any birth
17 from the computation of the assessment. Upon demonstration of
18 financial need by a hospital, the association may provide for
19 installment payments of assessments.
