  2         An act relating to public school

  3         performance-based funding; providing funding to

  4         school districts based on performance or

  5         improvement as measured by the FCAT; providing

  6         for calculation of awards; providing for use of

  7         funds; providing appropriations; providing an

  8         effective date.

10  Be It Enacted by the Legislature of the State of Florida:

11  

12         Section 1.  Performance-based FCAT funding.--As of July

13  1, 2003, results are reported for each of the FCAT tests for

14  reading and mathematics at each grade level 3 through 10. For

15  purposes of this section, this results in a total of 16

16  categories in which school districts may receive performance

17  or improvement funds based on the achievement of their

18  students in the testing categories of the FCAT.

19         (1)  School districts shall be recognized for their

20  accomplishment in attaining the highest performance scores, as

21  determined by mean scale score, in each of the 16 FCAT

22  categories. Upon ranking all the school districts in the state

23  to reflect the highest performance in each of the 16

24  categories of the FCAT, the top 10 school districts in each

25  category shall be allocated an amount of money based on the

26  outstanding performance of their students. The calculation for

27  individual school district awards shall be calculated pursuant

28  to subsection (3).

29         (2)  School districts shall be recognized for their

30  accomplishment in gaining the highest improvement in

31  performance scores, as determined by mean scale score, in each

 1  of the 16 FCAT categories. Upon ranking all the school

 2  districts in the state to reflect the highest improvement in

 3  each of the 16 categories of FCAT testing, the top 10 school

 4  districts in each category shall be allocated an amount of

 5  money based on the outstanding improvement of their students.

 6  The calculation for individual school district awards shall be

 7  calculated pursuant to subsection (3).

 8         (3)  Total unweighted FTE shall be used as the basis

 9  for purposes of calculating the awards for each qualifying

10  school district.  For each of subsections (1) and (2), the

11  number of FTE from the previous year shall be determined for

12  the top 10 school districts in each of the 16 categories. The

13  calculation of a dollar amount per FTE shall be performed to

14  determine a share value of each FTE and specific allocation

15  for each school district. The calculation shall be as follows:

16  the school district placing tenth in a category shall receive

17  one share per FTE; the school district placing ninth in a

18  category shall receive two shares per FTE; the school district

19  placing eighth in a category shall receive three shares per

20  FTE; the school district placing seventh in a category shall

21  receive four shares per FTE; the school district placing sixth

22  in a category shall receive five shares per FTE; the school

23  district placing fifth in a category shall receive six shares

24  per FTE; the school district placing fourth in a category

25  shall receive seven shares per FTE; the school district

26  placing third in a category shall receive eight shares per

27  FTE; the school district placing second in a category shall

28  receive nine shares per FTE; and the school district placing

29  first in a category shall receive ten shares per FTE. Once the

30  total number of FTE shares required for each of the two

31  performance-based incentives pursuant to subsections (1) and

 1  (2) is determined, that number shall be divided into the

 2  respective appropriation to determine a dollar value per FTE

 3  share for each of the two performance-based incentives. The

 4  calculation of the dollar value per FTE share for subsections

 5  (1) and (2) shall be performed independently of one another.

 6  The two per FTE dollar values shall be used in calculating the

 7  awards for each of the 16 categories for subsections (1) and

 8  (2). Final allocations from the Department of Education to

 9  school districts shall be determined by totaling award dollars

10  from both performance-based incentives by school district.

11         (4)  Performance or improvement funds earned pursuant

12  to this section shall be utilized in support of supplemental

13  academic instruction programs.

14         (5)  Nothing in this section shall preclude school

15  districts from earning additional dollars for enhancement,

16  performance, or improvement as provided elsewhere by law.

17         Section 2.  There is appropriated from the General

18  Revenue Fund to the Department of Education for fiscal year

19  2003-2004 the sum of $25 million to implement the provisions

20  of subsection (1) of section 1 of this act and $25 million to

21  implement the provisions of subsection (2) of section 1 of

22  this act.

23         Section 3.  This act shall take effect July 1, 2003.
