Be It Enacted by the Legislature of the State of Florida: |
|

|
|
|

|
Section 1. Subsection (2) of section 373.116, Florida |
|
20
|
Statutes, is amended, and subsection (3) is added to said |
|
21
|
section, to read: |
|

|
373.116 Procedure for water use and impoundment |
|
23
|
construction permit applications.-- |
|

|
(2) Upon receipt of an application for a permit of the |
|
25
|
type referred to in subsection (1), the governing board shall |
|
26
|
cause a notice thereof to be published in a newspaper having |
|
27
|
general circulation within the affected area. In addition, the |
|
28
|
governing board shall send, by regular or electronicmail, a |
|
29
|
copy of such notice to any person who has filed a written |
|
30
|
request for notification of any pending applications affecting |
|
31
|
this particular designated area. Upon written request,Notice of |
|
32
|
application for the consumptive use of water shall be sent |
|
33
|
mailed by regular or electronicmail to the county and |
|
34
|
appropriate city government from which boundaries the withdrawal |
|
35
|
is proposed to be made. |

(3) All permits issued under this section shall include |
|
37
|
the following language: |
|

|
|

|
"This permit does not convey to the |
|
40
|
permittee any property rights or privileges |
|
41
|
other than those specified herein or relieve |
|
42
|
the permittee from complying with any |
|
43
|
applicable local, state, or federal law, |
|
44
|
rule, or ordinance."

Section 2. This act shall take effect upon becoming a law. |
