2 An act relating to trust funds; creating the
3 Wildflower Trust Fund; providing for sources of
4 funds and purposes; providing for annual
5 carryforward of funds; providing for future
6 review and termination or re-creation of the
7 trust fund; providing a contingent effective
8 date.

10 Be It Enacted by the Legislature of the State of Florida:

12 Section 1. Wildflower Trust Fund.--
13 (1) The Wildflower Trust Fund is created within the
14 Department of Agriculture and Consumer Services. Funds shall
15 be credited to the trust fund as provided in Senate Bill 666,
16 to be used for the purposes set forth in that bill.
17 (2) Notwithstanding the provisions of section 216.301,
18 Florida Statutes, and pursuant to section 216.351, Florida
19 Statutes, any balance in the trust fund at the end of any
20 fiscal year must remain in the trust fund at the end of the
21 year and must be made available for carrying out the purposes
22 of the trust fund.
23 (3) In accordance with section 19(f)(2), Article III
24 of the State Constitution, the trust fund must, unless
25 terminated sooner, be terminated on July 1, 2007. Before its
26 scheduled termination, the trust fund must be reviewed as
27 provided in section 215.3206(1) and (2), Florida Statutes.
28 Section 2. This act shall take effect on the effective
29 date of Senate Bill 666, but it shall not take effect unless
30 it is enacted by a three-fifths vote of the membership of each

1 house of the Legislature and unless SB 666, 2003 Regular
2 Session, becomes a law.
