11 The Committee on Comprehensive Planning recommended the
12 following amendment:

14 Senate Amendment (with title amendment)
15 On page 2, lines 25-31, delete all of said lines
16
17 and insert:
18 Section 2. The City of Miami Beach is authorized and
19 directed to draw a warrant from funds of the municipality not
20 otherwise appropriated in the amount of $3,217,029.40, less
21 amounts payable pursuant to section 3, payable to Jeffrey
22 Akers as compensation for injuries and damages sustained by
23 Jeffrey Akers as a result of the negligence of the City of
24 Miami Beach. After payment of any outstanding liens not
25 specified in section 3, statutory attorney's fees, and costs,
26 the remaining proceeds shall be payable to Jeffrey Akers.
27 Section 3. The governmental entity responsible for
28 payment of the warrant shall pay to the Florida Agency for
29 Health Care Administration the amount due under section
30 409.910, Florida Statutes, prior to disbursing any funds to
31 the claimant. The amount due the agency shall be equal to all

1 unreimbursed medical payments paid by Medicaid up to the date
2 upon which this act takes effect.
