  1                      A bill to be entitled

  2         An act relating to gambling; prohibiting

  3         certain gambling activity from being conducted

  4         on vessels that embark and disembark within the

  5         state; providing a penalty; providing an

  6         effective date.

  8         WHEREAS, it is the intent of the Legislature to

  9  prohibit gambling in violation of chapter 849, Florida

10  Statutes, on vessels that operate from ports within this state

11  and that do not make an intervening stop within the boundaries

12  of another state or possession of the United States or a

13  foreign country at which passengers could disembark, NOW,

14  THEREFORE,

16  Be It Enacted by the Legislature of the State of Florida:

18         Section 1.  (1)  Effective January 1, 2004, a person

19  may not allow gambling activity in violation of chapter 849,

20  Florida Statutes, to be conducted on any vessel that such

21  person manages, supervises, controls, operates, or owns,

22  within or without the waters of this state, if the vessel

23  embarks from this state and disembarks within this state

24  without making an intervening stop in another state or

25  possession of the United States or a foreign country at which

26  passengers could disembark.

27         (2)  A person who violates this section commits a

28  felony of the third degree, punishable as provided in section

29  775.082, section 775.083, or section 775.084, Florida

30  Statutes.

31         Section 2.  This act shall take effect July 1, 2003.
