1 A bill to be entitled
2 An act relating to pari-mutuel wagering;
3 amending s. 550.09511, F.S.; reducing the rate
4 of tax on handle for certain jai alai
5 permitholders who conduct intertrack wagering;
6 amending s. 550.615, F.S.; revising provisions
7 with respect to intertrack wagering; removing a
8 limitation on receiving broadcasts of certain
9 races or games; providing an effective date.

11 Be It Enacted by the Legislature of the State of Florida:

13 Section 1. Subsection (3) of section 550.09511,
14 Florida Statutes, is amended to read:
15 550.09511 Jai alai taxes; abandoned interest in a
16 permit for nonpayment of taxes.--
17 (3)(a) Notwithstanding the provisions of subsection
18 (2) and s. 550.0951(3)(c)1., any jai alai permitholder which
19 is restricted under Florida law from operating live
20 performances on a year-round basis is entitled to conduct
21 wagering on live performances at a tax rate of 3.85 percent of
22 live handle. Such permitholder is also entitled to conduct
23 intertrack wagering as a host permitholder on live jai alai
24 games at its fronton at a tax rate of 2.0 3.3 percent of
25 handle at such time as the total tax on intertrack handle paid
26 to the division by the permitholder during the current state
27 fiscal year exceeds the total tax on intertrack handle paid to
28 the division by the permitholder during the 1992-1993 state
29 fiscal year.
30 (b) The payment of taxes pursuant to paragraph (a)
31 shall be calculated and commence beginning the day after the

1 biweekly period in which the permitholder is first entitled to
2 the reduced rate specified in this subsection.
3 Section 2. Subsection (2) of section 550.615, Florida
4 Statutes, is amended to read:
5 550.615 Intertrack wagering.--
6 (2) Any track or fronton licensed under this chapter
7 which in the preceding year conducted a full schedule of live
8 racing is qualified to, at any time, receive broadcasts of any
9 class of pari-mutuel race or game and accept wagers on such
10 races or games conducted by any class of permitholders
11 licensed under this chapter.
12 Section 3. This act shall take effect upon becoming a
13 law.

Reduces to 2.0 percent the tax on handle for jai alai
18 permitholders to conduct intertrack wagering as a host
permitholder on live jai alai games at its fronton.
19 Revises the provision of law governing intertrack
wagering to eliminate a requirement that the licensed
20 track or fronton must have conducted a full schedule of
live racing in the preceding year to be qualified for
21 intertrack wagering.
