  1                      A bill to be entitled

  2         An act relating to pyrotechnic devices;

  3         amending s. 633.171, F.S.; providing that the

  4         operation of pyrotechnic devices or fireworks

  5         in an indoor facility under certain conditions

  6         is a third-degree felony; providing an

  7         effective date.

  8  

  9  Be It Enacted by the Legislature of the State of Florida:

10  

11         Section 1.  Subsection (3) is added to section 633.171,

12  Florida Statutes, to read:

13         633.171  Penalty for violation of law, rule, or order

14  to cease and desist or for failure to comply with corrective

15  order.--

16         (3)(a)  An owner or operator of an indoor facility may

17  not knowingly allow the installation of a pyrotechnic device

18  or fireworks inside his or her facility without a

19  fire-suppression system or without a copy of a local fire

20  marshal's permit furnished to the owner or operator by a

21  vendor or licensee who wishes to install a pyrotechnic device

22  or fireworks inside the indoor facility.

23         (b)  A vendor or licensee may not install fireworks or

24  a pyrotechnic device in an indoor facility without a

25  fire-suppression system unless he or she first obtains a local

26  fire marshal's permit, furnishes a copy of that permit to the

27  owner or operator of the indoor facility, and obtains prior

28  written consent of the owner or operator to install the

29  fireworks or a pyrotechnic device inside his or her indoor

30  facility.

 1         (c)  A person who violates this subsection commits a

 2  felony of the third degree, punishable as provided in s.

 3  775.082, s. 775.083, or s. 775.084.

 4         Section 2.  This act shall take effect July 1, 2003.
