  1                      A bill to be entitled

  2         An act relating to Lake County; providing

  3         procedures by which the mobile home owners'

  4         association of a residential mobile home

  5         cooperative located within the county may

  6         alter, convert, lease, or modify the common

  7         areas of the mobile home cooperative; providing

  8         requirements for voting and notice; providing

  9         requirements for absentee ballots; providing an

10         effective date.

12  Be It Enacted by the Legislature of the State of Florida:

13  

14         Section 1.  Residential mobile home cooperatives in

15  Lake County.--Notwithstanding any other law, this act shall

16  govern residential mobile home cooperatives having more than

17  1,100 units and located within Lake County.

18         (1)  Unless other procedures are provided in the

19  documents of the mobile home cooperative or such action is

20  expressly prohibited by the articles of incorporation or

21  bylaws of the mobile home cooperative, the mobile home owners'

22  association may materially alter, convert, lease, or modify

23  the common areas of the residential mobile home cooperative if

24  the action is approved by an affirmative vote of not less than

25  a majority of total voting interests present at a duly noticed

26  meeting of the unit owners, or voting by absentee ballot.

27         (2)  At least 30 days prior to the date of the

28  scheduled unit owner's meeting, the association shall deliver

29  to each individual unit owner, by hand delivery or by

30  first-class United States mail, written notice of the date,

31  time, and purpose of the meeting. The notice must clearly

 1  state and describe, with sufficient particularity so as to be

 2  easily discernible by the unit owners, the issue that the unit

 3  owners are being asked to decide. The notice must be delivered

 4  to the address last furnished to the association by the unit

 5  owner. An absentee ballot enabling the unit owner to cast his

 6  or her vote must be included with the notice and must include

 7  a return envelope containing a first-class stamp.

 8         Section 2.  This act shall take effect upon becoming a

 9  law.
