1 A bill to be entitled
2          An act relating to specialty license plates; creating s.
3    320.08068, F.S.; creating a specialty license plate for
4    motorcycles; providing for the distribution of annual use
5    fees received from the sale of such plates; providing a
6    contingent effective date.

8          Be It Enacted by the Legislature of the State of Florida:
9         
10          Section 1. Section 320.08068, Florida Statutes, is created
11    to read:
12          320.08068 Motorcycle specialty license plates.--
13          (1) Notwithstanding the provisions of s. 320.08053, the
14    department shall develop a reduced-dimensions specialty license
15    plate for display on motorcycles.
16          (2) The department shall issue a specialty license plate
17    to the owner or lessee of any motorcycle upon request and
18    payment of the appropriate license taxes and fees.
19          (3) Each request must be made annually to the department,
20    accompanied by the following taxes and fees:
21          (a) The license tax required under s. 320.08.
22          (b) A license plate fee as required by s. 320.06(1)(b).
23          (c) A processing fee of $2.
24          (d) A license plate annual use fee as required in
25    subsection (4).
26          (4) A license plate annual use fee of $15 shall be
27    collected for each motorcycle specialty license plate. Annual
28    use fees shall be distributed to The Able Trust as custodial
29    agent. The Able Trust may use up to a maximum of 10 percent of
30    the use fees collected for administrative costs. All remaining
31    funds from the collection of the annual use fees shall be
32    distributed by The Able Trust as follows:
33          (a) Twenty-five percent to the Brain and Spinal Cord
34    Injury Program Trust Fund.
35          (b) Twenty-five percent to Prevent Blindness Florida.
36          (c) Fifty percent to the Florida Association of Centers
37    for Independent Living in the form of matching grants from
38    private, nongovernmental sources. Funds distributed to the
39    Florida Association of Centers for Independent Living must be
40    used for programs and activities serving disabled Floridians.

42          A maximum of 10 percent of the proceeds from the sale of the
43    plate may be used for administrative costs.
44          (5) If an owner or lessee to whom the department has
45    issued a motorcycle specialty license plate acquires a
46    replacement vehicle within the owner's registration period, the
47    department must authorize a transfer of the specialty license
48    plate to the replacement vehicle in accordance with s. 320.0609.
49    The annual use fee or processing fee may not be refunded.
50          (6) The motorcycle specialty license plate shall be 4
51    inches wide by 7 inches long and incorporate a red, white, and
52    blue color scheme approved by the department and may bear the
53    imprint of numerals from 1 to 999, inclusive, capital letters
54    “A" through “Z," or a combination thereof. The department shall
55    determine the maximum number of characters, including numerals
56    and letters. Motorcycle specialty license plates must be
57    otherwise of the same material as standard license plates issued
58    for any registration period. In small letters, the word
59    “Florida" must appear at the top of the plate.
60          (7) The department may issue personalized prestige plates
61    for license plates authorized in this section. Such plates shall
62    be issued in accordance with applicable provisions contained in
63    s. 320.0805.
64          Section 2. This act shall take effect July 1, 2003.
