An act relating to specialty license plates; creating s. |

320.08068, F.S.; creating a specialty license plate for |

|
motorcycles; providing for the distribution of annual use |
5
|
fees received from the sale of such plates; providing an |
6
|
effective date. |

Be It Enacted by the Legislature of the State of Florida: |
9
|
|
10
|
Section 1. Section 320.08068, Florida Statutes, is created |
11
|
to read: |
12
|
320.08068 Motorcycle specialty license plates.--
|
13
|
(1) Notwithstanding the provisions of s. 320.08053, the |
14
|
department shall develop a reduced dimensions specialty license |
15
|
plate for display on motorcycles.
|
16
|
(2) The department shall issue a specialty license plate |
17
|
to the owner or lessee of any motorcycle upon request and |
18
|
payment of the appropriate license taxes and fees.
|
19
|
(3) Each request must be made annually to the department, |
20
|
accompanied by the following taxes and fees:
|
21
|
(a) The license tax required under s. 320.08.
|
22
|
(b) A license plate fee as required by s. 320.06(1)(b).
|
23
|
(c) A processing fee of $2.
|
24
|
(d) A license plate annual use fee as required in |
25
|
subsection (4). |

|
(4) A license plate annual use fee of $15 shall be |
27
|
collected for each motorcycle specialty license plate. Annual |
28
|
use fees shall be distributed to The Able Trust as custodial |
29
|
agent. The Able Trust may retain a maximum of 10 percent of the |
30
|
proceeds from the sale of the license plate for administrative |
31
|
costs. The Able Trust shall distribute the remaining funds as |
32
|
follows:
|

|
(a) Twenty-five percent to the Brain and Spinal Cord |
34
|
Injury Program Trust Fund. |
35
|
(b) Twenty-five percent to Prevent Blindness Florida. |
36
|
(c) Twenty-five percent to the Foundation for Vocational |
37
|
Rehabilitation to support the Personal Care Attendant Program |
38
|
pursuant to s. 413.402. |
39
|
(d) Twenty-five percent to the Florida Association of |
40
|
Centers for Independent Living for the purpose of setting up |
41
|
Direct-Support Organizations for each center, and for programs |
42
|
and activities serving disabled Floridians. Each center |
43
|
participating in the development of a direct-support |
44
|
organization shall be eligible to apply through the Association |
45
|
for a start-up grant of up to $50,000. Thereafter, to the extent |
46
|
that funds are available, each participating center may apply |
47
|
for funds in the form of matching grants. The first year, the |
48
|
centers shall provide 25 cents for each dollar requested. The |
49
|
second year, the center shall provide 50 cents to each dollar |
50
|
requested, and thereafter, the center shall provide a dollar for |
51
|
dollar match for each dollar requested. The match shall be from |
52
|
private, nongovernmental sources. |

|
(5) If an owner or lessee to whom the department has |
54
|
issued a motorcycle specialty license plate acquires a |
55
|
replacement vehicle within the owner's registration period, the |
56
|
department must authorize a transfer of the specialty license |
57
|
plate to the replacement vehicle in accordance with s. 320.0609. |

|
The annual use fee or processing fee may not be refunded.
|

|
(6) The license plate shall be 4 inches wide by 7 inches |
60
|
long and incorporate a red, white, and blue color scheme |
61
|
approved by the department and may bear the imprint of numerals |
62
|
from 1 to 999, inclusive, capital letters "A" through "Z," or a |
63
|
combination thereof. The department shall determine the maximum |
64
|
number of characters, including numerals and letters. Motorcycle |
65
|
specialty license plates must be otherwise of the same material |
66
|
as standard license plates issued for any registration period. |

|
In small letters, the word "Florida" must appear at the top of |
68
|
the plate.

(7) The department may issue personalized prestige plates |
70
|
for license plates authorized in this section. Such plates shall |
71
|
be issued in accordance with applicable provisions contained in |
72
|
s. 320.0805. |

Section 2. This act shall take effect October 1, 2003. |
