1 A bill to be entitled
2 An act relating to to the East Lake Tarpon
3 Special Fire Control District, Pinellas County;
4 amending sections 3(2) and 11 of section 1 of
5 chapter 2000-477, Laws of Florida; providing
6 authority of the district with respect to land
7 that is annexed by a municipality or other fire
8 control district; providing for collection and
9 payment of fire services taxes or assessments
10 by such municipality or other district;
11 providing for future repeal of the amendments
12 made by the act; providing effective dates.

14 Be It Enacted by the Legislature of the State of Florida:
15
16 Section 1. Subsection (2) of section 3 of section 1 of
17 chapter 2000-477, Laws of Florida, is amended to read:
18 Section 3. Formation; boundaries.--
19 (2) Any lands within a municipality included in the
20 boundaries of the District, as described herein, shall be
21 excluded from the District and its jurisdiction. If any area,
22 tract, or parcel of land within the boundaries of the District
23 shall hereafter become annexed to a municipality, such area,
24 tract, or parcel of land shall be excluded from the District
25 effective the next January 1 following such annexation by a
26 municipality; however, the District shall continue to provide
27 services to the annexed area pursuant to section 11.
28 Section 2. Section 11 of section 1 of chapter
29 2000-477, Laws of Florida, is amended to read:

1 districts.--Notwithstanding chapter 171, Florida Statutes, or
2 any other applicable law or ordinance, if any municipality or
3 other fire control district annexes land within the District,
4 the District shall continue as the sole taxing, enforcing, and
5 service-providing authority for District purposes in the
6 annexed land. However, any municipality or other fire control
7 district that annexes such land may collect the applicable
8 assessment or tax for fire services and pay the District for
9 such services at the District's annually adopted standard
10 rate. For the purposes and requirements of this Act, after the
11 annexation by a municipality of any unincorporated area within
12 the East Lake Tarpon Special Fire Control District, the
13 annexed area shall be treated as lying within the corporate
14 boundaries of the annexing municipality, and shall not be
15 subject to a levy of the ad valorem tax which is authorized by
16 this Act.
17 Section 3. Effective January 1, 2009, subsection (2)
18 of section 3 of section 1 of chapter 2000-477, Laws of
19 Florida, as amended by this act, is amended to read:

2 section 1 of chapter 2000-477, Laws of Florida, as amended by
3 this act, is amended to read:
4 Section 11. Annexation of territories by
5 municipalities or other fire control districts.--For the
6 purposes and requirements of this Act, after the annexation by
7 a municipality of any unincorporated area within the East Lake
8 Tarpon Special Fire Control District, the annexed area shall
9 be treated as lying within the corporate boundaries of the
