1 A bill to be entitled
2 An act relating to Monroe County; amending
3 chapter 76-441, Laws of Florida, as amended by
4 chapter 87-454, Laws of Florida; extending the
5 period within which any person who is 60 years
6 of age or older or a totally and permanently
7 disabled American veteran meeting low income
8 standards may apply for a special lower rate,
9 fee, rental, or other charge; providing an
10 effective date.

12 WHEREAS, the Florida Keys Aqueduct Authority is
13 authorized to provide a senior citizens' discount program
14 pursuant to section 14 of chapter 76-441, Laws of Florida, as
15 amended, and currently takes applications therefore between
16 January and March and the FKAA desires to extend the
17 application period for such program throughout the entire
18 year, NOW, THEREFORE,

20 Be It Enacted by the Legislature of the State of Florida:
21
22 Section 1. Subsection (2) of section 14 of chapter
23 76-441, Laws of Florida, as amended by chapter 87-454, Laws of
24 Florida, is amended to read:
25 Section 14. Fees, rentals, and charges; procedure for
26 adoption and modification, minimum revenue requirements.--
27 (2) Such rates, fees, rentals, and charges shall be
28 just and equitable and, except as provided herein, uniform for
29 users of the same class and, where appropriate, may be based
30 or computed either upon the amount of service furnished or
31 upon the number or average number of persons working or

1 residing or working or otherwise occupying the premises served
2 or upon any other factor affecting the use of the facilities
3 furnished, or upon any combination of the foregoing factors as
4 may be determined by the board of directors on an equitable
5 basis. The Authority may prescribe, fix, and establish a
6 special lower rate, fee, rental, or other charge on the
7 residential account of any person who is 60 years of age or
8 older or a totally and permanently disabled American veteran
9 on the date of application, who meets the low income standards
10 adopted by the board and who applies for such special lower
11 rate, fee, rental, or other charge between the months of
12 January and December March, inclusive, of each year. As used
13 in this section "residential account" means an account for a
14 person residing in a house, mobile home, condominium,
15 apartment, or other housing unit. The application shall
16 include the submission of an affidavit stating that the
17 applicant is 60 years of age or older or a totally and
18 permanently disabled American veteran. The submission of the
19 affidavit shall be prima facie evidence of the applicant's age
20 or disability. The application shall also include the annual
21 income of the applicant. The Authority may waive, in whole or
22 in part, any impact fees or charges for any governmental
23 entity; any charitable, educational, religious, or similar
24 organization exempt from taxation under the provisions of the
25 U.S. Internal Revenue Code; any person or entity exempt from
26 ad valorem property taxes under the laws of this state; or
27 housing defined as affordable by chapter 86-192, Laws of
28 Florida, or the rules adopted thereunder, the cost parameters
29 of which may be adjusted by the ratio of the Monroe County
30 cost of living index to the Florida average cost of living
31 index.

1 Section 2. This act shall take effect upon becoming a
2 law.
