1 A bill to be entitled
2 An act relating to the Lee County School
3 District; requiring the Lee County School Board
4 to submit to the electors of the county school
5 district the question of whether the district
6 school board shall consist of five members,
7 each to be elected from a single-member
8 residence area by electors residing in that
9 residence area only; requiring the district
10 school board to provide for the orderly
11 transition to such election of district school
12 board members, if approved; providing for the
13 staggering of district school board member
14 terms; providing for a referendum; providing a
15 ballot statement; providing an effective date.

17 Be It Enacted by the Legislature of the State of Florida:

19 Section 1. (1) The Lee County School Board shall
20 submit to the electors of the county school district for
21 approval or rejection at a referendum in conjunction with the
22 2004 general election the question of whether the district
23 school board shall be composed of five members, each to be
24 elected from a single-member residence area by electors
25 residing in the single-member residence area only,
26 notwithstanding the provisions of section 1001.36, section
27 1001.361, or section 1001.362, Florida Statutes.
28 (2) If the electors approve such election of district
29 school board members, the five single-member residence areas
30 must be drawn by the district school board, and the district
31 school board shall provide for the orderly transition to such

1 election of district school board members in the general
2 election of 2006. All five school board seats will be up for
3 reelection in the general election of 2006 and staggered from
4 that date forward. If for any reason there is a countywide
5 election prior to the 2004 general election and 2004
6 primaries, the vote for this act will occur on the earlier
7 date. If it is prior to the qualifying period for the 2004
8 general election, all school board seats will be up for
9 election in the year 2004 and staggered from that point
10 forward.
11 Section 2. In accordance with section 101.161, Florida
12 Statutes, and section 1 of this act, the Supervisor of
13 Elections of Lee County shall place the title and substance of
14 the referendum on the ballot as follows:

16 ELECTION OF LEE COUNTY SCHOOL BOARD MEMBERS
17 TO PROVIDE FOR SINGLE-MEMBER REPRESENTATION
18
19 Shall the election of Lee County School Board members be
20 changed so that board members are elected by the electors
21 living in their districts, rather than countywide?
22 Yes
23 No
24 Section 3. This act shall take effect upon approval of
25 a majority vote of those qualified electors of Lee County
26 voting in a referendum to be held by the supervisor of
27 elections in conjunction with the next primary, general,
28 special, or other election to be held in Lee County, except
29 that this section shall take effect upon becoming a law.
