1 A bill to be entitled
2 An act relating to Lee County; amending the Lee
3 County Home Rule Charter to provide for the
4 election of commissioners from single
5 districts; providing for the creation of
6 districts; providing an exception; providing
7 for a referendum; providing a ballot statement;
8 providing for the staggering of commissioner
9 terms; providing an effective date.

11 Be It Enacted by the Legislature of the State of Florida:

13 Section 1. Section 2.2 A. of Article II of the Lee
14 County Home Rule Charter is amended to read:
15 Section 2. In accordance with the requirements of
16 section 101.161, Florida Statutes, and section 3, the
17 Supervisor of Elections of Lee County shall place the title
18 and substance of the referendum on the ballot as follows:

20 ELECTION OF LEE COUNTY COMMISSION
21 MEMBERS TO PROVIDE FOR SINGLE-MEMBER REPRESENTATION

23 Shall the election of Lee County Commission members be changed
24 so that commissioners are elected by the people who live in
25 their districts, rather than countywide?
26 Yes
27 No
28 Section 3. If for any reason there is a countywide
29 election prior to the 2004 general election and 2004
30 primaries, the vote for this act will occur on this earlier
31 date. If it is prior to the qualifying period for the 2004

1 general election, all county commission seats will be up for
2 election in the year 2004 and staggered from that point
3 on. If the next countywide election is in 2004, all county
4 commission seats will be up for election in the year 2006 and
5 staggered from that point on.
6 Section 4. This act shall take effect only upon its
7 approval by a majority vote of those qualified electors of Lee
8 County voting in a referendum to be held by the Lee County
9 Board of County Commissioners in conjunction with the next
10 regular primary, special, general, or other election, in
11 accordance with the provisions of law relating to elections
12 currently in force, except that this section shall take effect
13 upon becoming a law.
