1 A bill to be entitled
2 An act relating to Central County Water Control
3 District, Hendry County; amending ch. 2000-415,
4 Laws of Florida; requiring that the supervisors
5 of the district be elected by a vote of
6 qualified electors residing in the district;
7 establishing procedures and extending certain
8 supervisor terms for the implementation of this
9 act; providing an effective date.

11 Be It Enacted by the Legislature of the State of Florida:

13 Section 1. Section 9 of section 3 of chapter 2000-415,
14 Laws of Florida, is amended to read:
15 Section 9. Board of supervisors membership.--
16 (1) Definition.--As used in this section, the term
17 "qualified elector" means any person at least 18 years of age
18 who is a citizen of the United States, a permanent resident of
19 Florida, and a resident of the district who registers with the
20 Supervisor of Elections of Hendry County in accordance with
21 the election laws of this state.
22 (2) Composition of board of supervisors.--
23 (a) The number of members of the district board of
24 supervisors shall be 5. At each annual meeting of the
25 district, two supervisors will be elected for 3-year terms,
26 except that in elections held at the annual meetings in 2000
27 and every third year thereafter on supervisor will be elected
28 for a 3-year term.
29 (b) The board members shall be elected by the
30 qualified electors of the district in accordance with the laws
31 of Florida governing nonpartisan elections.

1 (c) Supervisors shall be qualified electors of the
2 district.
3 (3) Terms of office.--
4 (a) Each supervisor elected by qualified electors
5 shall serve a term of 4 years.
6 (b) The terms of each supervisor of the district
7 holding office on the effective date of this act shall be
8 extended until the second Tuesday following the next general
9 election held after said supervisor's term would have
10 otherwise expired.
11 (c) If a vacancy occurs in a seat occupied by a
12 governing board member, the remaining members of the board of
13 supervisors shall, within 60 days after receipt of a
14 resignation or notice of a member's death or other
15 disqualification, appoint a person who would be eligible to
16 hold the office until the next general election held at least
17 160 days after the appointment. At such election, a
18 supervisor shall be elected for the remainder of the term of
19 the vacating member.
20 Section 2. Section 1 of this act shall take effect
21 only upon its approval by a majority vote of the qualified
22 electors of the district, as defined in this act, to be held
23 at the district's annual meeting in April 2003, except that
24 this section shall take effect upon becoming a law.
