11          An act relating to student financial assistance;
12    prohibiting certain funds from being used to provide
13    financial assistance to certain postsecondary education
14    students who are citizens of specified countries;
15    requiring the reallocation of funds to certain students;
16    providing nonapplicability to certain persons; providing
17    an effective date.

19          Be It Enacted by the Legislature of the State of Florida:
20         
21          Section 1. Notwithstanding any other provision of law to
22    the contrary, no funds from general revenue, the lottery, or
23    financial aid fee revenues shall be used to provide student
24    financial assistance in the form of scholarships, fellowships,
25    grants, loans, tuition or fee waivers, or other financial
26    assistance to any nonresident alien student who is enrolled in a
27    Florida public postsecondary educational institution and who is
28    a citizen of any country that is identified by the United States
29    Department of State as terrorist or supporting terrorism. For
30    purposes of this act, nonresident alien student means a
31    nonimmigrant student who is not a citizen or national of the
32    United States and who has been admitted to the United States
33    temporarily for a specific purpose in either the F-1 or M-1 visa
34    categories and who is admitted for duration of status and does
35    not have the right to remain in this country indefinitely. A
36    student’s country of citizenship shall be determined at the time
37    of a student’s enrollment. A nonresident alien student who has
38    been determined ineligible pursuant to the provisions of this
39    section shall remain ineligible for such assistance while
40    enrolled in a Florida public postsecondary educational
41    institution. However, if a student’s country of citizenship is
42    removed from the United States Department of State list of
43    identified countries, such student shall become eligible for
44    student financial assistance pursuant to the provisions of this
45    section.
46          Section 2. The amount of student financial assistance
47    provided by Florida public postsecondary educational
48    institutions to students specified in section 1 of this act
49    during fiscal year 2001-2002 from general revenue, lottery
50    funds, or financial aid fee revenues shall be reallocated by the
51    institutions to eligible students who are both United States
52    citizens and Florida residents.
53          Section 3. This act shall not apply to a nonresident of
54    the state who is eligible to apply for residence under the Cuban
55    Adjustment Act of 1966, Pub. L. No. 89-732.
56          Section 4. This act shall take effect July 1, 2003.
