7 placing limitations on the use of sale
8 proceeds; providing an effective date.

10 Be It Enacted by the Legislature of the State of Florida:
11
12 Section 1. Paragraph (mm) is added to subsection (4)
13 of section 320.08056, Florida Statutes, to read:
14 320.08056 Specialty license plates.--
15 (4) The following license plate annual use fees shall
16 be collected for the appropriate specialty license plates:
17 (mm) Child Abuse Prevention and Intervention license
18 plate, $25.
19 Section 2. Subsection (39) is added to section
20 320.08058, Florida Statutes, to read:
21 320.08058 Specialty license plates.--
22 (39) CHILD ABUSE PREVENTION AND INTERVENTION LICENSE
23 PLATES.--
24 (a) The department shall develop a Child Abuse
25 Prevention and Intervention license plate as provided in this
26 section. The word "Florida" must appear at the top of the
27 plate, and the words "Stop Child Abuse" must appear at the
28 bottom of the plate.
29 (b) The annual use fees shall be distributed to the
30 Children's Home Society of Florida and the Florida Network of
31 Children's Advocacy Centers as follows: The first $90,000 in

1 annual use fees shall be equally divided between the two
2 organizations, to be used to pay start-up costs, including
3 costs incurred in developing and issuing the plates.
4 Thereafter, 50 percent of the proceeds shall be distributed to
5 the Children's Home Society of Florida, which must distribute
6 the funds proportionately to each of its divisions, to be used
7 for child abuse prevention programs. The other 50 percent of
8 the proceeds shall be distributed to the board of directors
9 of the Florida Network of Children's Advocacy Centers, Inc.,
10 who shall develop funding criteria and an allocation
11 methodology that ensures an equitable distribution of those
12 funds among network participant centers that meet the
13 standards set forth in s. 39.3035. The criteria and
14 methodologies shall take into account factors that include,
15 but need not be limited to, the center's accreditation status
16 with respect to the National Children's Alliance, the number
17 of clients served, and the population of the area being served
18 by the children's advocacy center.
19 (c) For the first 5 years in which the plate is
20 issued, a maximum of 20 percent of the fees collected may be
21 used for administrative costs directly associated with the
22 operation of the marketing and promotion of the plate. Ten
23 percent of the fees shall be allocated to the Children's Home
24 Society of Florida and 10 percent shall be allocated to the
25 Florida Network of Children's Advocacy Centers, Inc. Five
26 years after the date the first license plate is issued,
27 revenues from plate sales may not be used for marketing or
28 promoting the license plate.
29 Section 3. This act shall take effect July 1, 2003.
