1 A bill to be entitled
2 An act relating to the Department of Juvenile
3 Justice; amending s. 985.407, F.S.; requiring
4 the department to adopt by rule procedures for
5 changing policies that affect certain
6 contracted services and programs; requiring
7 procedures for notice, public comment,
8 assessment of fiscal impact, and response by
9 the department; providing an effective date.

11 Be It Enacted by the Legislature of the State of Florida:

13 Section 1. Present subsections (2), (3), and (4) of
14 section 985.407, Florida Statutes, are redesignated as
15 subsections (3), (4), and (5), respectively, and a new
16 subsection (2) is added to that section to read:
17 985.407 Departmental contracting powers; personnel
18 standards and screening.--
19 (2) The department shall adopt a rule pursuant to
20 chapter 120 establishing a procedure to provide notice of
21 policy changes that affect contracted delinquency services and
22 programs. A policy is defined as an operational requirement
23 that applies to only the specified contracted delinquency
24 service or program. The procedure shall include:
25 (a) Public notice of policy development.
26 (b) Opportunity for public comment on the proposed
27 policy.
28 (c) Assessment for fiscal impact upon the department
29 and providers.
30 (d) The department's response to comments received.
31 Section 2. This act shall take effect July 1, 2003.
