                | 12 | An act relating to the Florida Building Code; specifying | 
              
                | 13 | legislative approval of certain recommendations of the | 
              
                | 14 | Florida Building Commission relating to certain provisions | 
              
                | 15 | of the Florida Building Code; requiring the commission to | 
              
                | 16 | adopt certain provisions as part of the Florida Building | 
              
                | 17 | Code; providing legislative findings; exempting the | 
              
                | 18 | adoption of such provisions from certain requirements of | 
              
                | 19 | law or commission rules; amending s. 399.106, F.S.; | 
              
                | 20 | increasing membership on the Elevator Safety Technical | 
              
                | 21 | Advisory Committee; deleting an obsolete requirement; | 
              
                | 22 | deleting a provision terminating existence of the | 
              
                | 23 | committee; providing an effective date. | 
              
                | 24 |  | 
              
                | 25 | Be It Enacted by the Legislature of the State of Florida: | 
              
                | 26 |  | 
              
                | 27 | Section 1.  The Legislature has reviewed the Florida | 
              
                | 28 | Building Commission's recommendations for Florida Building Code | 
              
                | 29 | provisions applicable to existing buildings that were submitted | 
              
                | 30 | with the commission's 2002 report. The Legislature approves such | 
              
                | 31 | recommendations, and the Florida Building Commission is directed | 
              
                | 32 | to adopt such provisions, as amended through the workshop and | 
              
                | 33 | adoption hearing process, as part of the Florida Building Code | 
              
                | 34 | pursuant to s. 120.54, Florida Statutes. The Legislature finds | 
              
                | 35 | that application of such provisions provides a benefit to the | 
              
                | 36 | citizens of this state and that adoption and implementation of | 
              
                | 37 | such provisions should not be delayed any more than required by | 
              
                | 38 | rulemaking procedures; therefore, initial adoption of such | 
              
                | 39 | provisions shall not be subject to the requirements of ss. | 
              
                | 40 | 553.73 and 553.77, Florida Statutes, or rules of the commission | 
              
                | 41 | as those rules or provisions of law relate to Florida Building | 
              
                | 42 | Code amendments, modifications, or updates. | 
              
                | 43 | Section 2.  Subsections (1), (3), and (4) of section | 
              
                | 44 | 399.106, Florida Statutes, are amended to read: | 
              
                | 45 | 399.106  Elevator Safety Technical Advisory Committee.-- | 
              
                | 46 | (1)  The Elevator Safety Technical Advisory Committee is | 
              
                | 47 | created within the Department of Business and Professional | 
              
                | 48 | Regulation, Division of Hotels and Restaurants, consisting of | 
              
                | 49 | eight sevenmembers to be appointed by the secretary of the | 
              
                | 50 | Department of Business and Professional Regulation as follows: | 
              
                | 51 | one representative from a major elevator manufacturing company | 
              
                | 52 | or its authorized representative; one representative from an | 
              
                | 53 | elevator servicing company; one representative from a building | 
              
                | 54 | design profession; one representative of the general public; one | 
              
                | 55 | representative of a local government in this state; one | 
              
                | 56 | representative of a building owner or manager; one | 
              
                | 57 | representative of labor involved in the installation, | 
              
                | 58 | maintenance, and repair of elevators, and one representative who | 
              
                | 59 | is a certified elevator inspector from a private inspection | 
              
                | 60 | service. The purpose of the committee is to provide technical | 
              
                | 61 | assistance to the division in support of protecting the health, | 
              
                | 62 | safety, and welfare of the public; to give the division the | 
              
                | 63 | benefit of the committee members' knowledge and experience | 
              
                | 64 | concerning the industries and individual businesses affected by | 
              
                | 65 | the laws and rules administered by the division. | 
              
                | 66 | (3)  The committee shall meet and organize not later than  | 
              
                | 67 | 45 days prior to the convening of the 2002 Legislature. This  | 
              
                | 68 | committee terminates December 31, 2003.

                | 69 | (3) (4)The committee may consult with engineering | 
              
                | 70 | authorities and organizations concerned with standard safety | 
              
                | 71 | codes for recommendations to the department regarding rules and | 
              
                | 72 | regulations governing the operation, maintenance, servicing, | 
              
                | 73 | construction, alteration, installation, or inspection of | 
              
                | 74 | vertical conveyances subject to this chapter. | 
              
                | 75 | Section 3.  This act shall take effect upon becoming a law. |
