11	An act relating to food safety; creating s. 500.033, F.S.;
12	creating the Florida Food Safety and Food Security
13	Advisory Council as a forum for evaluation of food safety
14	and food security issues; providing membership; requiring
15	reporting of findings and recommendations; providing for
16	review of certain data; providing appropriations;
17	providing an effective date.

19	Be It Enacted by the Legislature of the State of Florida:
20
21	Section 1. Section 500.033, Florida Statutes, is created
22	to read:
23	500.033 Florida Food Safety and Food Security Advisory
24	Council.--
25	(1) There is created the Florida Food Safety and Food
26	Security Advisory Council for the purpose of serving as a forum
27	for presenting, investigating, and evaluating issues of current
28	importance to the assurance of a safe and secure food supply to
29	the citizens of Florida. The Florida Food Safety and Food
30	Security Advisory Council shall consist of, but not be limited
31	to: the Commissioner of Agriculture or his or her designee; the
32	Secretary of Health or his or her designee; the Secretary of
33	Business and Professional Regulation or his or her designee;
34	members representing the production, processing, distribution,
35	and sale of foods; consumers and/or members of citizens groups
36	or food industry groups; scientists or other experts in aspects
37	of food safety from state universities; representatives from
38	local, state, and federal agencies that are charged with
39	responsibilities for food safety or food security; the chairs of
40	the Agriculture Committees of the Senate and the House of
41	Representatives or their designees; and the chairs of the
42	committees of the Senate and the House of Representatives with
43	jurisdictional oversight of home defense issues or their
44	designees. The Commissioner of Agriculture shall appoint the
45	remaining members. The council shall make periodic reports to
46	the Department of Agriculture and Consumer Services concerning
47	findings and recommendations in the area of food safety and food
48	security.
49	(2) The council shall consider the development of
50	appropriate advice or recommendations on food safety or food
51	security issues. In the discharge of their duties, the council
52	members may receive for review confidential data exempt from the
53	provisions of s. 119.07(1); however, it is unlawful for any
54	member of the council to use the data for his or her advantage
55	or reveal the data to the general public.
56	Section 2. There is hereby provided a continuing
57	appropriation in the expenses category the sum of $5,000 from
58	the Contract and Grants Trust Fund within the Department of
59	Agriculture and Consumer Services and the sum of $5,000 from the
60	General Inspection Trust Fund within the Department of
61	Agriculture and Consumer Services for use in payment of
62	associated costs in the conduct of activities of the Florida
63	Food Safety and Food Security Advisory Council.
64	Section 3. This act shall take effect July 1, 2003.
