11	An act relating to food safety; creating s. 500.033, F.S.;
12	creating the Florida Food Safety and Food Security
13	Advisory Council as a forum for evaluation of food safety
14	and food security issues; providing membership; requiring
15	reporting of findings and recommendations; providing for
16	review of certain data; providing appropriations;
17	providing an effective date.

19	Be It Enacted by the Legislature of the State of Florida:
20
21	Section 1. Section 500.033, Florida Statutes, is created
22	to read:
23	500.033 Florida Food Safety and Food Security Advisory
24	Council.--
25	(1) There is created the Florida Food Safety and Food
26	Security Advisory Council for the purpose of serving as a forum
27	for presenting, investigating, and evaluating issues of current
28	importance to the assurance of a safe and secure food supply to
29	the citizens of Florida. The Florida Food Safety and Food
30	Security Advisory Council shall consist of, but not be limited
31	to: the Commissioner of Agriculture or his or her designee; the
32	Secretary of Health or his or her designee; the Secretary of
33	Business and Professional Regulation or his or her designee; the
34	person responsible for domestic security with the Florida
35	Department of Law Enforcement; members representing the
36	production, processing, distribution, and sale of foods;
37	consumers and/or members of citizens groups or food industry
38	groups; scientists or other experts in aspects of food safety
39	from state universities; representatives from local, state, and
40	federal agencies that are charged with responsibilities for food
41	safety or food security; the chairs of the Agriculture
42	Committees of the Senate and the House of Representatives or
43	their designees; and the chairs of the committees of the Senate
44	and the House of Representatives with jurisdictional oversight
45	of home defense issues or their designees. The Commissioner of
46	Agriculture shall appoint the remaining members. The council
47	shall make periodic reports to the Department of Agriculture and
48	Consumer Services concerning findings and recommendations in the
49	area of food safety and food security.
50	(2) The council shall consider the development of
51	appropriate advice or recommendations on food safety or food
52	security issues. In the discharge of their duties, the council
53	members may receive for review confidential data exempt from the
54	provisions of s. 119.07(1); however, it is unlawful for any
55	member of the council to use the data for his or her advantage
56	or reveal the data to the general public.
57	Section 2. There is hereby provided for fiscal year 2003-
58	2004 an appropriation in the expenses category the sum of $5,000
59	from the Contract and Grants Trust Fund within the Department of
60	Agriculture and Consumer Services and the sum of $5,000 from the
61	General Inspection Trust Fund within the Department of
62	Agriculture and Consumer Services for use in payment of
63	associated costs in the conduct of activities of the Florida
64	Food Safety and Food Security Advisory Council.
65	Section 3. This act shall take effect July 1, 2003.
