of fingerprints; requiring personnel to be subject to |

state and federal rules and regulations; providing an |

effective date. |

Be It Enacted by the Legislature of the State of Florida: |

|

Section 1. Paragraph (a) of subsection (12) of section |
15
|
1002.33, Florida Statutes, is amended to read: |

|
1002.33 Charter schools.-- |
17
|
(12) EMPLOYEES OF CHARTER SCHOOLS.-- |
18
|
(a) A charter school shall select its own employees. A |
19
|
charter school may contract with its sponsor for the services of |
20
|
personnel employed by the sponsor.Charter school personnel |
21
|
shall be subject to state and federal rules and regulations that |
22
|
govern public school personnel. |

Section 2. Section 1012.47, Florida Statutes, is created |
24
|
to read: |

|
1012.47 Employment of alternative school personnel.--All |
26
|
instructional and noninstructional personnel who are hired to |
27
|
fill positions requiring direct contact with students in an |
28
|
alternative school that operates under contract with a district |
29
|
school system shall, upon employment and according to conditions |
30
|
of the contract, file a complete set of fingerprints as required |
31
|
in s. 1012.32. Such personnel shall be subject to state and |
32
|
federal rules and regulations that govern public school |
33
|
personnel. |

Section 3. This act shall take effect July 1, 2003. |
