12          An act relating to the Pinellas County Construction
13    Licensing Board, Pinellas County; amending part II of
14    chapter 75-489, Laws of Florida, as amended; revising
15    composition of the board; providing for severability;
16    providing an effective date.

18          WHEREAS, the Pinellas County Gulf Beach Communities have
19    construction issues unique to those beach communities which
20    warrant permanent representation on the Pinellas County
21    Construction Licensing Board, NOW, THEREFORE,
22         
23          Be It Enacted by the Legislature of the State of Florida:
24         
25          Section 1. Subsections (1) and (3) of section 12 of part
26    II of chapter 75-489, Laws of Florida, as amended by chapters
27    78-594, 81-466, 86-444, 89-504, 93-387, and 2002-350, Laws of
28    Florida, are amended to read:

30          Section 12. PINELLAS COUNTY CONSTRUCTION LICENSING BOARD:
31    ORGANIZATION: MEETINGS AND POWERS.--
32          (1) The Pinellas County Construction Licensing Board is
33    created within the county of Pinellas, consisting of twenty-one
34    (21)twenty (20)members, two (2) of whom are primarily engaged
35    in business as general contractors; two (2) of whom are
36    primarily engaged in business as building contractors, two (2)
37    of whom are primarily engaged in business as residential
38    contractors, one (1) who is a Florida registered architect doing
39    business in Pinellas County, one (1) who is an electrical
40    contractor, one (1) who is a plumbing contractor, one (1) who is
41    a mechanical contractor, one who is a roofing or sheet metal
42    contractor, one (1) who is a swimming pool, aluminum or veneer
43    specialty contractor, two (2) fire marshals, the three (3)
44    building directors of the following: City of St. Peters burg,
45    City of Clearwater and County of Pinellas, one (1) North county
46    building director from one of the following municipalities:
47    Tarpon Springs, Dunedin, Oldsmar, Safety Harbor, Belleair,
48    Belleair Beach, Belleair Bluffs, Belleair Shores,or Largo,
49    Indian Shores, or Indian Rocks Beach, one (1) South county
50    building director from one of the following municipalities:
51    South Pasadena, Gulfport, St. Petersburg Beach, Treasure Island,
52    Madeira Beach, Seminole, Kenneth City, Redington Beach, No.
53    Redington Beach, Redington Shores, or Pinellas Park, one (1)
54    Beach Community building director from one of the following: the
55    Town of Belleair Beach, the Town of Belleair Shores, the City of
56    Redington Beach, the City of North Redington Beach, the City of
57    Madeira Beach, the City of Indian Rocks Beach, the Town of
58    Indian Shores, the Town of Redington Shores, the City of
59    Treasure Island, and the City of St. Pete Beach, and one (1)
60    consumer member who is a resident and citizen of Pinellas County
61    and who is not and never has been a member or practitioner of
62    any of the trades or professions regulated by the board or a
63    member or practitioner of any closely related trade or
64    profession. All members of the board shall be residents of
65    Pinellas County and appointed by the Chairman of the Board of
66    County Commissioners.
67          (3) Members of the board shall be selected as follows:
68          The three (3) building directors of the City of Clearwater,
69    City of St. Petersburg and the County of Pinellas; one (1) North
70    county building director and one (1) South county building
71    director selected by the Chairman of the Board of County
72    Commissioners from the municipalities listed in subsection (1);
73    one (1) Beach Community building director appointed from a list
74    of three (3) nominees submitted by The Barrier Island
75    Governmental Council; a Florida Registered Architect appointed
76    from a list of three recommended architects submitted by the
77    American Institute of Architects Florida Central Chapter, St.
78    Petersburg and Clearwater Sections; two (2) of whom are
79    primarily engaged in business as general contractors from a list
80    of five (5) submitted by the Associated General Contractors of
81    Mid-Florida, Inc.; two (2) of whom are primarily engaged in
82    business as Building Contractors from a list of five (5)
83    submitted by the Contractors and Builders Association of
84    Pinellas County; two (2) of whom are primarily engaged in the
85    business as residential building contractors from a list of five
86    (5) submitted by the Contractors and Builders Association of
87    Pinellas County; one (1) who is an electrical contractor from a
88    list of five (5) supplied by the Electrical Council of Florida,
89    Pinellas County Chapter; one (1) who is a Plumbing contractor
90    from a list of five (5) supplied by the Pinellas Association of
91    Plumbing-Heating-Cooling Contractors, Inc.; two (2) of whom are
92    fire marshals, who shall be active members of the Tampa Bay Area
93    Fire Marshals Association, from a list of five (5) supplied by
94    said association, one (1) of whom shall serve an initial term of
95    three (3) years, the other to serve an initial term of two (2)
96    years, with successors to serve for a term of two (2) years
97    thereafter; one (1) who is a mechanical or Class A air
98    conditioning contractor from a list of five (5), supplied by the
99    Refrigeration and Air Conditioning Contractors’ Association
100    (“RACCA”); one (1) roofing or sheet metal contractor and one (1)
101    swimming pool, aluminum or veneer specialty contractor selected
102    by the Chairman of the Board of County Commissioners; one
103    consumer member to be appointed by the Chairman of the Board of
104    County Commissioners in accordance with paragraph 2(a). The
105    building director members from the City of Clearwater, from the
106    City of St. Petersburg and Pinellas County, shall be permanent
107    members of the board. All other members shall serve terms of two
108    (2) years. The following members shall commence their terms in
109    even-numbered years: the Florida registered architect, one (1)
110    general contractor, one (1) building contractor or, one (1)
111    residential building contractor, one (1) electrical contractor,
112    one (1) fire marshal, the North county,and South county, and
113    Beach Communitybuilding directors. The following members shall
114    commence their terms in odd-numbered years: one (1) general
115    contractor, one (1) building contractor, one (1) residential
116    building contractor, one (1) mechanical contractor, one (1)
117    plumbing contractor, one (1) fire marshal, one (1) roofing or
118    sheet metal contractor, one (1) swimming pool, aluminum or
119    veneer specialty contractor, and one (1) consumer member. As
120    the terms of members expire, the Chairman of the Board of County
121    Commissioners of Pinellas County shall appoint a member to fill
122    the vacancy for a term of two (2) years in the same manner as
123    that membership was originally filledfiled. The architect,
124    contractor, electrical, plumbing and mechanical members shall be
125    selected from the county at large. The board shall elect one of
126    its members to serve as chairman and one of its members to serve
127    as vice-chairman, for a term to be set by the board. All terms
128    of office expire on September 30 of the last year of the term.
129    Vacancies in the membership occurring prior to the end of a
130    member’s term for any cause shall be filled by appointment in
131    the same manner as that membership was originally filled.
132          Section 2. If any section, subsection, sentence, clause,
133    phrase, or provision of this act is for any reason held invalid
134    or unconstitutional by any court of competent jurisdiction, such
135    holding shall not be construed to render the remaining
136    provisions of this act invalid or unconstitutional.
137          Section 3. This act shall take effect upon becoming a law.
