An act relating to the Pinellas County Construction |

Licensing Board, Pinellas County; amending part II of |

chapter 75-489, Laws of Florida, as amended; revising |

composition of the board; providing for severability; |

WHEREAS, the Pinellas County Gulf Beach Communities have |
9
|
construction issues unique to those beach communities which |
10
|
warrant permanent representation on the Pinellas County |
11
|
Construction Licensing Board, NOW, THEREFORE, |
12
|
|
13
|
Be It Enacted by the Legislature of the State of Florida: |
14
|
|
15
|
Section 1. Subsections (1) and (3) of section 12 of part |
16
|
II of chapter 75-489, Laws of Florida, as amended by chapters |
17
|
78-594, 81-466, 86-444, 89-504, 93-387, and 2002-350, Laws of |
18
|
Florida, are amended to read: |

|

|
Section 12. PINELLAS COUNTY CONSTRUCTION LICENSING BOARD: |
21
|
ORGANIZATION: MEETINGS AND POWERS.-- |
22
|
(1) The Pinellas County Construction Licensing Board is |
23
|
created within the county of Pinellas, consisting of twenty-one |
24
|
(21)twenty (20)members, two (2) of whom are primarily engaged |
25
|
in business as general contractors; two (2) of whom are |
26
|
primarily engaged in business as building contractors, two (2) |
27
|
of whom are primarily engaged in business as residential |
28
|
contractors, one (1) who is a Florida registered architect doing |
29
|
business in Pinellas County, one (1) who is an electrical |
30
|
contractor, one (1) who is a plumbing contractor, one (1) who is |
31
|
a mechanical contractor, one who is a roofing or sheet metal |
32
|
contractor, one (1) who is a swimming pool, aluminum or veneer |
33
|
specialty contractor, two (2) fire marshals, the three (3) |
34
|
building directors of the following: City of St. Peters burg, |
35
|
City of Clearwater and County of Pinellas, one (1) North county |
36
|
building director from one of the following municipalities: |
37
|
Tarpon Springs, Dunedin, Oldsmar, Safety Harbor, Belleair, |
38
|
Belleair Beach, Belleair Bluffs, Belleair Shores,or Largo, |
39
|
Indian Shores, or Indian Rocks Beach, one (1) South county |
40
|
building director from one of the following municipalities: |
41
|
South Pasadena, Gulfport, St. Petersburg Beach, Treasure Island, |
42
|
Madeira Beach, Seminole, Kenneth City, Redington Beach, No. |
43
|
Redington Beach, Redington Shores, or Pinellas Park, one (1) |
44
|
Beach Community building director from one of the following: the |
45
|
Town of Belleair Beach, the Town of Belleair Shores, the City of |
46
|
Redington Beach, the City of North Redington Beach, the City of |
47
|
Madeira Beach, the City of Indian Rocks Beach, the Town of |
48
|
Indian Shores, the Town of Redington Shores, the City of |
49
|
Treasure Island, and the City of St. Pete Beach, and one (1) |
50
|
consumer member who is a resident and citizen of Pinellas County |
51
|
and who is not and never has been a member or practitioner of |
52
|
any of the trades or professions regulated by the board or a |
53
|
member or practitioner of any closely related trade or |
54
|
profession. All members of the board shall be residents of |
55
|
Pinellas County and appointed by the Chairman of the Board of |
56
|
County Commissioners. |

|
(3) Members of the board shall be selected as follows: |
58
|
The three (3) building directors of the City of Clearwater, |
59
|
City of St. Petersburg and the County of Pinellas; one (1) North |
60
|
county building director and one (1) South county building |
61
|
director selected by the Chairman of the Board of County |
62
|
Commissioners from the municipalities listed in subsection (1); |
63
|
one (1) Beach Community building director appointed from a list |
64
|
of three (3) nominees submitted by The Barrier Island |
65
|
Governmental Council; a Florida Registered Architect appointed |
66
|
from a list of three recommended architects submitted by the |
67
|
American Institute of Architects Florida Central Chapter, St. |
68
|
Petersburg and Clearwater Sections; two (2) of whom are |
69
|
primarily engaged in business as general contractors from a list |
70
|
of five (5) submitted by the Associated General Contractors of |
71
|
Mid-Florida, Inc.; two (2) of whom are primarily engaged in |
72
|
business as Building Contractors from a list of five (5) |
73
|
submitted by the Contractors and Builders Association of |
74
|
Pinellas County; two (2) of whom are primarily engaged in the |
75
|
business as residential building contractors from a list of five |
76
|
(5) submitted by the Contractors and Builders Association of |
77
|
Pinellas County; one (1) who is an electrical contractor from a |
78
|
list of five (5) supplied by the Electrical Council of Florida, |
79
|
Pinellas County Chapter; one (1) who is a Plumbing contractor |
80
|
from a list of five (5) supplied by the Pinellas Association of |
81
|
Plumbing-Heating-Cooling Contractors, Inc.; two (2) of whom are |
82
|
fire marshals, who shall be active members of the Tampa Bay Area |
83
|
Fire Marshals Association, from a list of five (5) supplied by |
84
|
said association, one (1) of whom shall serve an initial term of |
85
|
three (3) years, the other to serve an initial term of two (2) |
86
|
years, with successors to serve for a term of two (2) years |
87
|
thereafter; one (1) who is a mechanical or Class A air |
88
|
conditioning contractor from a list of five (5), supplied by the |
89
|
Refrigeration and Air Conditioning Contractors’ Association |
90
|
(“RACCA”); one (1) roofing or sheet metal contractor and one (1) |
91
|
swimming pool, aluminum or veneer specialty contractor selected |
92
|
by the Chairman of the Board of County Commissioners; one |
93
|
consumer member to be appointed by the Chairman of the Board of |
94
|
County Commissioners in accordance with paragraph 2(a). The |
95
|
building director members from the City of Clearwater, from the |
96
|
City of St. Petersburg and Pinellas County, shall be permanent |
97
|
members of the board. All other members shall serve terms of two |
98
|
(2) years. The following members shall commence their terms in |
99
|
even-numbered years: the Florida registered architect, one (1) |
100
|
general contractor, one (1) building contractor or, one (1) |
101
|
residential building contractor, one (1) electrical contractor, |
102
|
one (1) fire marshal, the North county,and South county, and |
103
|
Beach Communitybuilding directors. The following members shall |
104
|
commence their terms in odd-numbered years: one (1) general |
105
|
contractor, one (1) building contractor, one (1) residential |
106
|
building contractor, one (1) mechanical contractor, one (1) |
107
|
plumbing contractor, one (1) fire marshal, one (1) roofing or |
108
|
sheet metal contractor, one (1) swimming pool, aluminum or |
109
|
veneer specialty contractor, and one (1) consumer member. As |
110
|
the terms of members expire, the Chairman of the Board of County |
111
|
Commissioners of Pinellas County shall appoint a member to fill |
112
|
the vacancy for a term of two (2) years in the same manner as |
113
|
that membership was originally filledfiled. The architect, |
114
|
contractor, electrical, plumbing and mechanical members shall be |
115
|
selected from the county at large. The board shall elect one of |
116
|
its members to serve as chairman and one of its members to serve |
117
|
as vice-chairman, for a term to be set by the board. All terms |
118
|
of office expire on September 30 of the last year of the term. |

|
Vacancies in the membership occurring prior to the end of a |
120
|
member’s term for any cause shall be filled by appointment in |
121
|
the same manner as that membership was originally filled. |

|
Section 2. If any section, subsection, sentence, clause, |
123
|
phrase, or provision of this act is for any reason held invalid |
124
|
or unconstitutional by any court of competent jurisdiction, such |
125
|
holding shall not be construed to render the remaining |
126
|
provisions of this act invalid or unconstitutional.

Section 3. This act shall take effect upon becoming a law. |
