An act relating to the City of Jacksonville; amending |

chapter 92-341, Laws of Florida, as amended; clarifying |
4
|
exemptions provided in the Charter of the City of |
5
|
Jacksonville to the civil service status of designated |
6
|
positions; providing an effective date. |

WHEREAS, the City of Jacksonville has determined that it is |
9
|
in its best interest to consolidate its housing programs within |
10
|
a new housing commission, and |
11
|
WHEREAS, the city has determined that it is in its best |
12
|
interest to provide for appointed employees for the new |
13
|
agencies, while ensuring that present employees retain the right |
14
|
to revert to their civil service positions, and |
15
|
WHEREAS, the city and the property appraiser wish to codify |
16
|
the status of appointed employees in that office and to confirm |
17
|
reversion rights for said employees, NOW, THEREFORE, |
18
|
|

|
Be It Enacted by the Legislature of the State of Florida: |

|

|
Section 1. Subsections (gg) and (hh) are added to section |
22
|
17.06 of the Charter of the City of Jacksonville, as created by |
23
|
chapter 92-341, Laws of Florida, as amended, to read: |

|
ARTICLE 17. CIVIL SERVICE |
25
|
Section 17.06 Applicability of civil service system to |
26
|
employees of consolidated government.--The civil service |
27
|
provisions of this charter shall be applicable to all employees |
28
|
of the consolidated government except: |
29
|
(gg) All persons employed by the Housing and Community |
30
|
Development Commission (HCDC) and the Housing and Community |
31
|
Development Finance Commission (HCDFC), except those employees |
32
|
of organizations who were transferred into the HCDC or the HCDFC |
33
|
on July 1, 2003, as a result of the creation of the HCDC and the |
34
|
HCDFC pursuant to the City Ordinance Code and who elected to |
35
|
retain civil service status.

(hh) All persons employed in the Office of the Property |
37
|
Appraiser, except those employees who elected to retain civil |
38
|
service status prior to January 1, 2000.
|

Any person in the classified civil service who is appointed to a |
41
|
position exempted from the civil service system by this section |
42
|
shall be entitled to return to the same or a comparable civil |
43
|
service classification, with the same rights and status as held |
44
|
immediately prior to such appointment. Compensation for an |
45
|
employee returning to a civil service classification under this |
46
|
provision will be based upon the rate that he or she would have |
47
|
been receiving had the appointment not been made. This paragraph |
48
|
shall not apply to employees exempted from civil service |
49
|
provisions by subsections (a), (c), (e), (f), (i), or (q). |

|
Section 2. This act shall take effect upon becoming a law. |
