| 2 | An act relating to public funds; amending s. 215.85, F.S.; | ||
| 3 | authorizing local governments to pay certain expenses by | ||
| 4 | means of electronic funds transfer; providing an effective | ||

| 7 | Be It Enacted by the Legislature of the State of Florida: | ||
| 8 | |||
| 9 | Section 1. Subsection (5) of section 215.85, Florida | ||
| 10 | Statutes, is amended to read: | ||
| 11 | 215.85 Direct deposit of public funds.-- | ||
| 12 | (5) PROCEDURES FOR WIRE TRANSFER OF | ||
| 13 | FUNDS.--Notwithstanding any other provision of law, the | ||
| 14 | governing board or officer of any local government who has the | ||
| 15 | authority to deposit or withdraw funds is authorized to transfer | ||
| 16 | funds from one depository to another or within a depository or | ||
| 17 | to another institution, and may transfer funds wherein the | ||
| 18 | transfer does not represent an expenditure, advance, or | ||
| 19 | reduction of cash assets, except that a local government may | ||
| 20 | electronically transfer funds to pay expenses evidenced by a | ||
| 21 | valid invoice. Such transfer may be made by electronic, | ||
| 22 | telephonic, or other medium; and each transfer shall be | ||
| 23 | confirmed in writing and signed by the designee of the governing | ||
| 24 | board or officer of the local government. | ||
| 25 | Section 2. This act shall take effect July 1, 2003. | ||
