appropriation; providing an effective date. |

Be It Enacted by the Legislature of the State of Florida: |
13
|
|

|
Section 1. Section 1 of chapter 2001-152, Laws of Florida, |
15
|
is amended to read: |
16
|
Section 1. (1) The Department of Children and Family |
17
|
Services shallexpand thedevelop aclient-directed and |
18
|
recovery-based program known as Florida Self-Directed Care |
19
|
choice-based pilot projectin district 4 to provide mental |
20
|
health treatment and support services to adults who havea |
21
|
serious mental illnessand mental health and support services to |
22
|
children with serious mental disturbance, children with |
23
|
emotional disturbance, and children at risk of emotional |
24
|
disturbance. Theprogram shall continue to be based upon |
25
|
voluntary participation by clients andprojectshallcontinue to |
26
|
test a payment model in which each client controls the money |
27
|
that is available for that client's mental health treatment and |
28
|
support services. Theprogramproject shall be evaluated by an |
29
|
independent entity whoseevaluation must include an assessment |
30
|
of: |

|
(a) The criteria for selecting adult mental health clients |
32
|
with serious mental illness eligible for participation in the |
33
|
programproject. |

|
(b) The criteria for selecting child mental health clients |
35
|
with serious mental disturbance, child mental health clients |
36
|
with emotional disturbance, and child mental health clients at |
37
|
risk of emotional disturbance for participation in the program. |

|
(c)(b)The duties and responsibilities of thesystem |
39
|
guidescare coordinator. |
40
|
(d)(c)The accessibility and quality of services provided |
41
|
under theprogramprojectby available community-based providers |
42
|
selected by the client, compared to those services that are |
43
|
available without theprogramproject. |
44
|
(e)(d)The input by the clients in the development of |
45
|
service andtreatment plans compared to other clients not |
46
|
participating in theprogramproject. |
47
|
(f)(e)The achievement of individual treatment goals or |
48
|
outcome measures established for each client participating in |
49
|
theprogramprojectcompared to othermental healthclients. |
50
|
(g)(f)Any demonstrated improvements or cost savings in |
51
|
the delivery of community-based mental health treatment and |
52
|
support services, including an explanation of the analyses used |
53
|
in determining cost savings. |

|
(h)(g)All monitoring and oversight conducted by the |
55
|
Department of Children and Family Services or the Agency for |
56
|
Health Care Administration. |

|
(i)(h)Any existing or appointed local advisory group |
58
|
assisting in the design and implementation of theprogram |
59
|
project. |

|
(2) The program shall be administered by the Institute for |
61
|
Health and Human Services at Florida State University. The |
62
|
program director is authorized to expend the funds as necessary |
63
|
to maintain the established integrity and intent of the program, |
64
|
to include the purchase of services for clients, program staff |
65
|
employment and retention, and program evaluation. The purchase |
66
|
of services for clients shall be conducted in accordance with |
67
|
the self-identified needs of each client as those needs |
68
|
specifically relate to recovery from mental illness for adults |
69
|
and recovery from behavioral and emotional disturbances for |
70
|
children. The services shall include, but not be limited to, |
71
|
those services defined by the Department of Children and Family |
72
|
Services Mental Health and Substance Abuse Program Central |
73
|
Offices. The Institute for Health and Human Services at Florida |
74
|
State University shall continue development of this program in |
75
|
cooperation with the Department of Children and Family Services |
76
|
Mental Health Program Office. |

(3)(2)TheInstitute for Health and Human Services at |
78
|
Florida State UniversityDepartment of Children and Family |
79
|
Servicesshall submit a report concerning the progress of the |
80
|
programprojectto the appropriate legislative committees |
81
|
annually on December 1by December 1, 2002, and December 1, |
82
|
2003.This report shall contain a detailed strategic plan for |
83
|
statewide implementation of this client-directed, recovery-based |
84
|
program in collaboration with the Department of Children and |
85
|
Family Services Mental Health Program Office and the Agency for |
86
|
Health Care Administration. |

|
(3) This section expires July 1, 2004. |

|
Section 2.There is hereby appropriated for fiscal year |
89
|
2003-2004 from the Alcohol, Drug Abuse, and Mental Health Trust |
90
|
Fund in the Department of Children and Family Services to the |
91
|
Institute for Health and Human Services at Florida State |
92
|
University the sum of $470,000 for the purpose of implementing |
93
|
the provisions of this act. The Department of Children and |
94
|
Family Services district 4 shall make available no more than |
95
|
$500,000 of general revenue funds allocated to district 4 for |
96
|
fiscal year 2003-2004 for the purchase of client services. |
97
|
Section 3. This act shall take effect July 1, 2003. |
