7    following:

11 A bill to be entitled
12          An act relating to mental health; amending s. 1 of ch.
13    2001-152, Laws of Florida; directing the Department of
14    Children and Family Services to expand the district 4
15    mental health pilot project; providing for a client-
16    directed and recovery-based mental health program;
17    allowing for expansion of the program to provide services
18    to children; providing that the department shall contract
19    for administration of the program; providing for funding;
20    providing an effective date.

22          Be It Enacted by the Legislature of the State of Florida:
23         
24          Section 1. Section 1 of chapter 2001-152, Laws of Florida,
25    is amended to read:
26          Section 1. (1) The Department of Children and Family
27    Services may expand theshall develop a client-directed and
28    recovery-based program known as Florida Self-Directed Care
29    choice-based pilot projectin district 4 to provide mental
30    health treatment and support services to adults who have a
31    serious mental illness. After the program has enrolled all of
32    the eligible adults, the department may expand the self-directed
33    care mental health and support services program to children with
34    serious mental disturbance, children with emotional disturbance,
35    and children at risk of emotional disturbance. Participation in
36    the program shall continue to be voluntary and the programThe
37    project shall continue totest a payment model in which each
38    client controls the money that is available for that client's
39    mental health treatment and support services. The program
40    project shall be evaluated by an independent entity whose
41    evaluation must include an assessment of:
42          (a) The criteria for selecting adult mental health clients
43    with serious mental illness eligible for participation in the
44    programproject.
45          (b) The criteria for selecting child mental health clients
46    with serious mental disturbance, child mental health clients
47    with emotional disturbance, and child mental health clients at
48    risk of emotional disturbance for participation in the program.
49          (c)(b) The duties and responsibilities of the system
50    guidescare coordinator.
51          (d)(c)The accessibility and quality of services provided
52    under the programprojectby available community-based providers
53    selected by the client, compared to those services that are
54    available without the programproject.
55          (e)(d) The input by the clients in the development of
56    service andtreatment plans compared to other clients not
57    participating in the programproject.
58          (f)(e)The achievement of individual treatment goals or
59    outcome measures established for each client participating in
60    the programproject compared to other mental healthclients.
61          (g)(f)Any demonstrated improvements or cost savings in
62    the delivery of community-based mental health treatment and
63    support services, including an explanation of the analyses used
64    in determining cost savings.
65          (h)(g)All monitoring and oversight conducted by the
66    Department of Children and Family Services or the Agency for
67    Health Care Administration.
68          (i)(h)Any existing or appointed local advisory group
69    assisting in the design and implementation of the program
70    project.
71          (2) The department shall contract for the administration
72    of the program. The contract shall specify that the program
73    director is authorized to expend the funds as necessary to
74    maintain the established integrity and intent of the program, to
75    include the purchase of services for clients and program staff
76    employment and retention. The purchase of services for clients
77    shall be conducted in accordance with the self-identified needs
78    of each client as those needs specifically relate to recovery
79    from mental illness for adults and recovery from behavioral and
80    emotional disturbances for children. The services shall include,
81    but not be limited to, those services defined by the Department
82    of Children and Family Services Mental Health and Substance
83    Abuse Program Central Offices.
84          (3)(2)The Department of Children and Family Services
85    shall submit a report concerning the progress of the program
86    project to the appropriate legislative committees annually on
87    December 1by December 1, 2002, and December 1, 2003. This
88    report shall contain a detailed strategic plan for statewide
89    implementation of client-directed, recovery-based services.
90          (3) This section expires July 1, 2004.
91          Section 2. The Department of Children and Family Services
92    district 4 shall make available no more than $500,000 of general
93    revenue funds allocated to district 4 for fiscal year 2003-2004
94    for the purchase of client services.
95          Section 3. This act shall take effect July 1, 2003.
