An act relating to Internet access in county and municipal |

libraries; requiring public libraries to install and |
13
|
maintain computer software or equivalent technology that |
14
|
prohibits access to obscene materials by minors; |
15
|
permitting libraries to prohibit access to materials that |
16
|
incite violence; providing that the installation of |
17
|
software or technology in a library having only one |
18
|
public-access computer is within the library's discretion; |
19
|
providing a finding of important state interest; providing |
20
|
an effective date. |

Be It Enacted by the Legislature of the State of Florida: |

|

|
Section 1. Each county or municipal public library that |
25
|
makes available for public use computer on-line service, |
26
|
Internet service, or local bulletin board service shall install |
27
|
and maintain computer software or equivalent technology on any |
28
|
computer that is made available to persons under 18 years of age |
29
|
which prohibits access to materials that contain obscene |
30
|
descriptions, photographs, or depictions. Such computer software |
31
|
or equivalent technology may also prohibit access to materials |
32
|
that incite violence against persons based on their race, |
33
|
gender, or religion. If the library has only one computer |
34
|
available for public use, the installation of such software or |
35
|
technology shall be within the discretion of the library. |

Section 2. In accordance with section 18, Article VII of |
37
|
the State Constitution, the Legislature finds that the |
38
|
installation and maintenance by public libraries of computer |
39
|
software or equivalent technology that prohibits access by |
40
|
persons under 18 years of age to obscene materials fulfills an |
41
|
important state interest. |

Section 3. This act shall take effect October 1, 2003. |
