1	A bill to be entitled
2	An act relating to Internet access in county and municipal
3	libraries; requiring public libraries to install and
4	maintain computer software or equivalent technology that
5	prohibits access to obscene materials by minors;
6	permitting libraries to prohibit access to materials that
7	incite violence; providing that the installation of
8	software or technology in a library having only one
9	public-access computer is within the library's discretion;
10	providing a finding of important state interest; providing
11	an effective date.

13	Be It Enacted by the Legislature of the State of Florida:

15	Section 1. Each county or municipal public library that
16	makes available for public use computer on-line service,
17	Internet service, or local bulletin board service shall install
18	and maintain computer software or equivalent technology on any
19	computer that is made available to persons under 18 years of age
20	which prohibits access to materials that contain obscene
21	descriptions, photographs, or depictions. Such computer software
22	or equivalent technology may also prohibit access to materials
23	that incite violence against persons based on their race,
24	gender, or religion. If the library has only one computer
25	available for public use, the installation of such software or
26	technology shall be within the discretion of the library.
27	Section 2. In accordance with section 18, Article VII of
28	the State Constitution, the Legislature finds that the
29	installation and maintenance by public libraries of computer
30	software or equivalent technology that prohibits access by
31	persons under 18 years of age to obscene materials fulfills an
32	important state interest.
33	Section 3. This act shall take effect October 1, 2003.
