1 A bill to be entitled
2 An act relating to public records; reviving,
3 reenacting, and amending s. 828.30(5), F.S.;
4 reenacting the exemption from public-records
5 requirements which pertains to certain
6 confidential information contained in a rabies
7 vaccination certificate provided to the animal
8 control authority; providing an effective date.

10 Be It Enacted by the Legislature of the State of Florida:
11
12 Section 1. Notwithstanding the repeal of subsection
13 (5) of section 828.30, Florida Statutes, which is scheduled to
14 occur October 2, 2003, that subsection is revived, reenacted,
15 and amended to read:
16 828.30 Rabies vaccination of dogs, cats, and
17 ferrets.--
18 (5) Any information contained in the rabies
19 vaccination certificate provided to the animal control
20 authority which identifies the owner of the animal vaccinated
21 is confidential and exempt from s. 119.07(1) and s. 24(a),
22 Art. I of the State Constitution. However, the physician of,
23 or, any person who has been bitten, scratched, or otherwise
24 exposed to a zoonotic disease and a veterinarian who is
25 treating an animal that has been bitten, scratched, or
26 otherwise exposed to a zoonotic disease or the owner of an
27 animal that has been bitten, scratched, or otherwise exposed
28 to a zoonotic disease, shall be provided with any information
29 contained in a rabies vaccination certificate but only with
30 respect to the particular animal biting, scratching, or
31 otherwise causing exposure. Any person with an animal tag

1 number may receive vaccination certificate information with
2 regard to that animal. Federal, state, and local law
3 enforcement and prosecutorial agencies; other animal control
4 authorities; and emergency and medical response, disease
5 control, or other governmental health agencies shall be
6 provided information contained in the rabies vaccination
7 certificate for the purpose of controlling the transmission of
8 rabies; however, they must not release such information to the
9 public. Any person, pursuant to a written request, may view
10 or copy any individual rabies vaccination certificate, one
11 record at a time. A copy of any existing database may be
12 obtained provided that the owner's name, street address, and
13 phone number, and the animal tag number, are not made
14 available.

16 This exemption is subject to the Open Government Sunset Review
17 Act of 1995 in accordance with s. 119.15, and shall stand
18 repealed on October 2, 2003, unless reviewed and saved from
19 repeal through reenactment by the Legislature.
20 Section 2. This act shall take effect October 1, 2003.
