1 A bill to be entitled
2 An act relating to public records; narrowing,
3 reenacting, and amending s. 828.30(5), F.S.;
4 reenacting the exemption from public-records
5 requirements which pertains to certain exempt
6 information contained in a rabies vaccination
7 certificate provided to the animal control
8 authority; providing an effective date.

10 Be It Enacted by the Legislature of the State of Florida:
11
12 Section 1. Notwithstanding the repeal of subsection
13 (5) of section 828.30, Florida Statutes, which is scheduled to
14 occur October 2, 2003, that subsection is revived, reenacted,
15 and amended to read:
16 828.30 Rabies vaccination of dogs, cats, and
17 ferrets.--
18 (5) An animal owner's name, street address, phone
19 number, and animal tag number Any information contained in a
20 the rabies vaccination certificate provided to the animal
21 control authority which identifies the owner of the animal
22 vaccinated is confidential and exempt from s. 119.07(1) and s.
23 24(a), Art. I of the State Constitution. However, the
24 physician of, or, any person who has been bitten, scratched,
25 or otherwise exposed to a zoonotic disease or the physician of
26 such person; and a veterinarian who is treating an animal that
27 has been bitten, scratched, or otherwise exposed to a zoonotic
28 disease; or the owner of an animal that has been bitten,
29 scratched, or otherwise exposed to a zoonotic disease, shall
30 be provided with any information contained in a rabies
31 vaccination certificate but only with respect to the

1 particular animal biting, scratching, or otherwise causing
2 exposure. Any person with an animal tag number may receive
3 vaccination certificate information with regard to that
4 animal. Federal, state, and local Law enforcement and
5 prosecutorial agencies,; other animal control authorities,;
6 and emergency and medical response and, disease control
7 agencies, or other governmental health agencies shall be
8 provided information contained in the rabies vaccination
9 certificate for the purpose of controlling the transmission of
10 rabies; however, the receiving agencies and authorities they
11 must not release the exempt such information to the public.
12 Any person, pursuant to a written request, may view or copy
13 any individual rabies vaccination certificate, one record at a
14 time. A copy of any existing database may be obtained
15 provided that the owner's name, street address, and phone
16 number, and the animal tag number, are not made available.

18 This exemption is subject to the Open Government Sunset Review
19 Act of 1995 in accordance with s. 119.15, and shall stand
20 repealed on October 2, 2003, unless reviewed and saved from
21 repeal through reenactment by the Legislature.
22 Section 2. This act shall take effect October 1, 2003.
