authorizing the Department of Corrections to deposit or |

|
transfer into the Crimes Compensation Trust Fund certain |
18
|
overpayments and other payments; repealing s. 960.0025, |
19
|
F.S., relating to the allocation of certain funds from |
20
|
restitution or other court-ordered payments; providing an |
21
|
effective date. |

Be It Enacted by the Legislature of the State of Florida: |
24
|
|

|
Section 1. Section 945.31, Florida Statutes, is amended to |
26
|
read: |
27
|
945.31 Restitution and other payments.--The department may |
28
|
establish bank accounts outside the State Treasury for the |
29
|
purpose of collecting and disbursing restitution and other |
30
|
court-ordered payments from persons in its custody or under its |
31
|
supervision, and may collect an administrative processing fee in |
32
|
an amount equal to 4 percent of the gross amounts of such |
33
|
payments. Such administrative processing fee shall be deposited |
34
|
in the General Revenuedepartment's Operating TrustFund and |
35
|
shall be used to offset the cost of the department's services. |

|
The department is authorized to deposit or transfer into the |
37
|
Crimes Compensation Trust Fund: |
38
|
(1) Offender overpayments that are less than $10 at the |
39
|
end of the offender's supervision.
|
40
|
(2) Offender funds that are not claimed within 1 year |
41
|
after supervision is terminated. |
42
|
(3) Victim restitution payments that are not claimed |
43
|
within 1 year after the offender's supervision is terminated. |
44
|
(4) Interest earned on balances in the COPS bank accounts. |
45
|
(5) Payments that cannot be identified and are not claimed |
46
|
within 1 year after they are received. |

|
Section 2. Section 960.0025, Florida Statutes, is |
48
|
repealed. |

|
Section 3. This act shall take effect upon becoming a law. |
