10 A bill to be entitled
11          An act relating to unclaimed court-ordered payments;
12    amending s. 945.31, F.S.; authorizing the Department of
13    Corrections to deposit or transfer into the General
14    Revenue Fund certain overpayments and other payments;
15    repealing s. 960.0025, F.S., relating to the allocation of
16    certain funds from restitution or other court-ordered
17    payments; providing an effective date.

19          Be It Enacted by the Legislature of the State of Florida:
20         
21          Section 1. Section 945.31, Florida Statutes, is amended to
22    read:
23          945.31 Restitution and other payments.--The department may
24    establish bank accounts outside the State Treasury for the
25    purpose of collecting and disbursing restitution and other
26    court-ordered payments from persons in its custody or under its
27    supervision, and may collect an administrative processing fee in
28    an amount equal to 4 percent of the gross amounts of such
29    payments. Such administrative processing fee shall be deposited
30    in the department's Operating Trust Fund and shall be used to
31    offset the cost of the department's services. The department is
32    authorized to deposit or transfer into the General Revenue Fund:
33          (1) Offender overpayments that are less than $10 at the
34    end of the offender's supervision.
35          (2) Offender funds that are not claimed within 1 year
36    after supervision is terminated.
37          (3) Victim restitution payments that are not claimed
38    within 1 year after the offender's supervision is terminated.
39          (4) Interest earned on balances in the COPS bank accounts.
40          (5) Payments that cannot be identified and are not claimed
41    within 1 year after they are received.
42          Section 2. Section 960.0025, Florida Statutes, is
43    repealed.
44          Section 3. This act shall take effect upon becoming a law.
