1	A bill to be entitled
2	An act relating to the John M. McKay Scholarships for
3	Students with Disabilities Program; amending s. 1002.39,
4	F.S.; requiring specified certification of teachers who
5	provide instruction to scholarship recipients in private
6	schools; providing an effective date.

8	Be It Enacted by the Legislature of the State of Florida:

10	Section 1. Paragraph (f) of subsection (4) of section
11	1002.39, Florida Statutes, is amended to read:
12	1002.39 The John M. McKay Scholarships for Students with
13	Disabilities Program.--There is established a program that is
14	separate and distinct from the Opportunity Scholarship Program
15	and is named the John M. McKay Scholarships for Students with
16	Disabilities Program, pursuant to this section.
17	(4) PRIVATE SCHOOL ELIGIBILITY.--To be eligible to
18	participate in the John M. McKay Scholarships for Students with
19	Disabilities Program, a private school must be a Florida private
20	school, may be sectarian or nonsectarian, and must:
21	(f) Beginning in the 2003-2004 school year,employ or
22	contract with teachers who are certified for each grade level,
23	subject area, and exceptionality in which the teacher provides
24	instruction to a recipient of a John M. McKay Scholarshiphold
25	baccalaureate or higher degrees, or have at least 3 years of
26	teaching experience in public or private schools, or have
27	special skills, knowledge, or expertise that qualifies them to
28	provide instruction in subjects taught.
29	Section 2. This act shall take effect upon becoming a law.
