18	and insert: mining activities must post and maintain a form of
19	financial security as required under subsection (2). Evidence
20	that the security has been posted and maintained in compliance
21	with this section must be maintained by any licensee or
22	permitholder for the use of explosives in connection with
23	construction materials mining activities as part of the
24	mandatory record maintenance requirements of s. 552.112. The
25	person must maintain, in a format approved by the Division of
26	State Fire Marshal of the Department of Financial Services, a
27	completed form that shows the amount and location of the
28	security or identifies the security and the current security
29	value.
30	(2) The security required under subsection (1) must be in
31	an amount not less than $100,000, notwithstanding an award made
32	by an administrative law judge under s. 552.40(7) and may be in
33	the form of a bond, letter of credit, certificate of deposit, or
34	other type of security approved by the Division of State Fire
35	Marshal of the Department of Financial Services. In the case of
36	multiple licenseholders and permitholders, a single security in
37	the aggregate amount of not less than $100,000 may be provided
38	as security for the individual permits and/or licenses. If the
39	user of explosives has not been identified as a respondent in
40	any pending claim for damages under ss. 552.32-552.44, and if
41	renewal of the license or permit is not sought, the security
42	required under this section may be released upon the expiration
43	of the license or permit, or 181 days after the final use of
44	explosives under the license, whichever occurs later, provided
45	the security to be released is not security for other permits or
46	licenses.
