1 A bill to be entitled
2          An act relating to motor vehicles; creating the Interstate
3    95 Lane Designation Pilot Project in Palm Beach County;
4    providing legislative purpose; requiring heavy trucks to
5    use the two outermost lanes; providing penalties for
6    violation; directing the Department of Transportation to
7    erect signs; requiring posting of signs prior to citation
8    for violation; providing for repeal; providing an
9    effective date.

11          Be It Enacted by the Legislature of the State of Florida:
12         
13          Section 1. Interstate 95 Lane Designation Pilot Project in
14    Palm Beach County.--
15          (1) There is created the Interstate 95 Lane Designation
16    Pilot Project in Palm Beach County. The purpose of the project
17    is to increase motorist safety, improve the flow of traffic, and
18    reduce the wear and tear on Interstate 95 by requiring heavy
19    trucks to use the two outermost lanes on that highway in Palm
20    Beach County. The pilot project shall last for 2 years.
21          (2) Any heavy truck having three or more axles shall
22    operate only on the two outermost right-hand lanes on Interstate
23    95 within the boundaries of Palm Beach County, except when the
24    vehicle is preparing for a left turn, avoiding a hazardous
25    condition on the road, or directed by a law enforcement officer
26    or other authorized official.
27          (3) A violation of subsection (2) is a noncriminal traffic
28    infraction, punishable as a moving violation as provided in
29    chapter 318, Florida Statutes.
30          (4) The Department of Transportation is directed to erect
31    suitable signs informing operators of heavy trucks and other
32    motorists of the lane requirements in subsection (2). There
33    shall be no citation for a violation of subsection (2) unless
34    such signs have been erected and are clearly visible to
35    motorists.
36          (5) This act is repealed October 1, 2005.
37          Section 2. This act shall take effect October 1, 2003.
