10 A bill to be entitled
11          An act relating to motor vehicles; creating the Interstate
12    95 Lane Designation Pilot Project in Palm Beach County;
13    providing legislative purpose; requiring heavy trucks to
14    use the two outermost lanes; providing penalties for
15    violation; directing the Department of Transportation to
16    erect signs; requiring posting of signs prior to citation
17    for violation; providing for repeal; providing an
18    effective date.

20          Be It Enacted by the Legislature of the State of Florida:
21         
22          Section 1. Interstate 95 Lane Designation Pilot Project in
23    Palm Beach County.--
24          (1) There is created the Interstate 95 Lane Designation
25    Pilot Project in Palm Beach County. The purpose of the project
26    is to increase motorist safety and improve the flow of traffic
27    on Interstate 95 by requiring heavy trucks to use the two
28    outermost lanes on that highway in Palm Beach County. The pilot
29    project shall last for 2 years.
30          (2) Any heavy truck having three or more axles shall
31    operate only on the two outermost right-hand lanes on Interstate
32    95 within the boundaries of Palm Beach County, except when the
33    vehicle is preparing for a left turn, avoiding a hazardous
34    condition on the road, or directed by a law enforcement officer
35    or other authorized official.
36          (3) A violation of subsection (2) is a noncriminal traffic
37    infraction, punishable as a moving violation as provided in
38    chapter 318, Florida Statutes.
39          (4) The Department of Transportation is directed to erect
40    suitable signs informing operators of heavy trucks and other
41    motorists of the lane requirements in subsection (2). There
42    shall be no citation for a violation of subsection (2) unless
43    such signs have been erected and are clearly visible to
44    motorists.
45          (5) This act is repealed October 1, 2005.
46          Section 2. This act shall take effect October 1, 2003.
