11  The Committee on Governmental Oversight and Productivity
12  recommended the following amendment:
13  
14         Senate Amendment (with title amendment) 
15         On page 4, between lines 15 and 16,
16  
17  insert:  
18         Section 4.  Section 43.195, Florida Statutes, is
19  transferred to section 90.959, Florida Statutes.
20         90.959 43.195  Disposal of physical evidence filed as
21  exhibits.--The clerk of any circuit court or county court may
22  dispose of items of physical evidence which have been held as
23  exhibits in excess of 3 years in cases on which no appeal is
24  pending or can be made.  Items of evidence having no monetary
25  value which are designated by the clerk for removal shall be
26  disposed of as unusable refuse.  Items of evidence having a
27  monetary value which are designated for removal by the clerk
28  shall be sold and the revenue placed in the clerk's general
29  revenue fund.
