15	Remove line(s) 168-172, and insert:
16	benefit district.
17	(c) As an alternative to the creation of an educational
18	facilities benefit district by a local general purpose
19	government pursuant to the procedures set forth in paragraphs
20	(a) and (b), a local general purpose government may adopt a
21	resolution with a finding of necessity and specification of the
22	geographic boundaries of the educational facilities benefit
23	district. The resolution must state that:
24	1. The economic, social, and housing circumstances in the
25	defined area create unique requirements for students in the
26	area.
27	2. A shortage of specifically targeted educational
28	opportunities exists to meet the unique requirements of students
29	in the defined area.
30	3. The creation of an educational facilities benefit
31	district is necessary to fulfill the requirements of the
32	students in the defined area.

34	The educational facilities benefit district shall be created by
35	ordinance in which the local general purpose government shall
36	accept data and analysis confirming that the conditions set
37	forth in the finding of necessity exist and can be met through
38	the educational opportunities offered by charter schools. The
39	creation of an educational facilities benefit district under
40	this subsection shall be conditioned upon the consent of the
41	local general purpose government creating such district. Prior
42	to January 2008, the authority to create an educational
43	facilities benefit district by a local general purpose
44	government pursuant to this subsection shall be limited to Dade
45	County.
