1 A bill to be entitled
2          An act relating to county tourism promotion agencies;
3    amending s. 125.01, F.S.; revising powers of the county
4    governing body; authorizing the county to prohibit
5    business entities that are not county tourism promotion
6    agencies from using certain specified designations;
7    amending s. 125.0104, F.S.; revising powers and duties of
8    county tourism promotion agencies; authorizing the use of
9    certain designations by said agencies; providing an
10    effective date.

12          Be It Enacted by the Legislature of the State of Florida:
13         
14          Section 1. Paragraph (dd) is added to subsection (1) of
15    section 125.01, Florida Statutes, to read:
16          125.01 Powers and duties.--
17          (1) The legislative and governing body of a county shall
18    have the power to carry on county government. To the extent not
19    inconsistent with general or special law, this power includes,
20    but is not restricted to, the power to:
21          (dd) Prohibit a business entity, other than a county
22    tourism promotion agency, from using names as specified in s.
23    125.0104(9)(e) when representing itself to the public as an
24    entity representing tourism interests of the county levying the
25    local option tourist development tax under s. 125.0104.
26          Section 2. Paragraph (e) is added to subsection (9) of
27    section 125.0104, Florida Statutes, to read:
28          125.0104 Tourist development tax; procedure for levying;
29    authorized uses; referendum; enforcement.--
30          (9) COUNTY TOURISM PROMOTION AGENCIES.--In addition to any
31    other powers and duties provided for agencies created for the
32    purpose of tourism promotion by a county levying the tourist
33    development tax, such agencies are authorized and empowered to:
34          (e) Represent themselves to the public as convention and
35    visitors bureaus, visitors bureaus, tourist development
36    councils, vacation bureaus, or county tourism promotion agencies
37    operating under any other name or names specifically designated
38    by ordinance.
39          Section 3. This act shall take effect upon becoming a law.
