surgery training programs and plastic surgery educational |
16
|
symposiums; providing for issuance of such certificates |
17
|
without examination to applicants who meet specified |
18
|
requirements; specifying the validity period of such |
19
|
certificates; limiting the number of certificates that may |
20
|
be issued per calendar year; providing financial |
21
|
responsibility requirements; prohibiting issuance of a |
22
|
certificate to a physician under investigation for a |
23
|
practice violation in another jurisdiction; providing an |
24
|
effective date. |

|
Be It Enacted by the Legislature of the State of Florida: |
27
|
|
28
|
Section 1. Section 458.3137, Florida Statutes, is created |
29
|
to read: |
30
|
458.3137 Temporary certificate for visiting physicians to |
31
|
obtain medical privileges for instructional purposes in |
32
|
conjunction with certain plastic surgery training programs and |
33
|
plastic surgery educational symposiums.--
|

|
(1) Any physician who has been invited by both:
|
35
|
(a) A plastic surgery training program that is affiliated |
36
|
with a Florida medical school that is accredited by the |
37
|
Accreditation Council for Graduate Medical Education; and
|
38
|
(b) An educational symposium cosponsored by the American |
39
|
Society of Plastic Surgeons, the Plastic Surgery Educational |
40
|
Foundation, or the American Society for Aesthetic Plastic |
41
|
Surgery,
|
42
|
|
43
|
may be issued a temporary certificate for limited privileges |
44
|
solely for purposes of providing educational training in plastic |
45
|
surgery in accordance with the restrictions set forth in this |
46
|
section.
|

|
(2) A temporary certificate to practice medicine for |
48
|
educational purposes to help teach plastic surgery residents of |
49
|
a Florida medical school in conjunction with a nationally |
50
|
sponsored educational symposium may be issued without |
51
|
examination, upon verification by the board that the individual |
52
|
meets all of the following requirements:
|
53
|
(a) Is a graduate of an accredited medical school or its |
54
|
equivalent or is a graduate of a foreign medical school listed |
55
|
with the World Health Organization.
|
56
|
(b) Holds a valid and unencumbered license to practice |
57
|
medicine in another state or country.
|
58
|
(c) Is a recognized expert in a specific area of plastic |
59
|
surgery as demonstrated by peer-review publications, invited |
60
|
lectureships, and academic affiliations.
|
61
|
(d) Has completed an application form adopted by the board |
62
|
and remitted a nonrefundable application fee not to exceed $300.
|
63
|
(e) Has not committed an act in this or any other |
64
|
jurisdiction that would constitute a basis for disciplining a |
65
|
physician under s. 456.072 or s. 458.331.
|

|
(f) Meets the financial responsibility requirements of s. |
67
|
458.320.
|
68
|
(g) Is applying only in connection with both a Florida |
69
|
medical school accredited by the Accreditation Council for |
70
|
Graduate Medical Education and an educational symposium |
71
|
sponsored by the American Society of Plastic Surgeons, the |
72
|
Plastic Surgery Educational Foundation, or the American Society |
73
|
for Aesthetic Plastic Surgery.
|

(3) A temporary certificate issued under this section is |
75
|
valid for no more than 3 days per year.
|

|
(4) The department shall not issue more than six temporary |
77
|
certificates under this section per calendar year.
|

|
(5) In order for a physician who is a graduate of a |
79
|
foreign medical school and holds a valid and unencumbered |
80
|
license to practice medicine in another country but does not |
81
|
hold a license to practice medicine in this or another state to |
82
|
obtain a temporary certificate under this section, the |
83
|
organization sponsoring the educational symposium must either |
84
|
obtain a surety bond issued by a surety company authorized to do |
85
|
business in this state to pay for medical malpractice judgments |
86
|
or establish a certificate of deposit or a guaranteed letter of |
87
|
credit with a licensed and insured bank or savings institution |
88
|
located in the state. The amount of the bond, certificate of |
89
|
deposit, or guaranteed letter of credit shall be an amount not |
90
|
less than $250,000.
|

|
(6) The board shall not issue a temporary certificate for |
92
|
practice to any physician who is under investigation in another |
93
|
jurisdiction for an act that would constitute a violation of |
94
|
this chapter or chapter 456 until such time as the investigation |
95
|
is complete and the physician is found innocent of all charges.
|

|
Section 2. This act shall take effect upon becoming a law. |
