11          An act relating to real property reform; requiring the
12    Office of Program Policy Analysis and Government
13    Accountability to review and evaluate changes to the laws
14    affecting land sales, exemptions, and mandatory
15    homeowners' associations and disclosure laws related to
16    adult and residential subdivisions; requiring the office
17    to consult with the Department of Business and
18    Professional Regulation, homeowners and homeowners'
19    associations, and developers and to hold hearings;
20    requiring a report; providing an effective date.

22          Be It Enacted by the Legislature of the State of Florida:
23         
24          Section 1. (1) The Office of Program Policy Analysis and
25    Government Accountability shall review and recommend appropriate
26    changes to the laws of this state affecting land sales,
27    exemptions, and mandatory homeowners’ and disclosure laws
28    related to adult and residential subdivisions. In conducting the
29    review, the office shall consider input from a variety of
30    sources, including, but not limited to, the Department of
31    Business and Professional Regulation, homeowners and homeowners'
32    associations, and developers. The office shall hold public
33    meetings in South Florida, Central Florida, and Jacksonville to
34    obtain input.
35          (2) The review shall evaluate the need for any changes and
36    additions to those laws which may be appropriate to protect the
37    interests of consumers and property owners on matters,
38    including, but not limited to, control of the homeowners'
39    association's operations, management and maintenance, disclosure
40    of financial reports by developers or owners, disclosure of all
41    governing documents governing real property, penalties for
42    noncompliance, oversight and funding for such protection of
43    interests, alternative dispute resolution, and assistance in the
44    formulation of rules to implement enforcement.
45          (3) By February 1, 2004, the office shall submit a report
46    of its findings and recommendations to the Governor, the
47    President of the Senate, and the Speaker of the House of
48    Representatives.
49          Section 2. This act shall take effect upon becoming a law.
