13	District, Palm Beach County; amending ch. 2001-313, Laws
14	of Florida; providing for authority to acquire property
15	for recreational purposes within a specified area of the
16	district; providing an effective date.

18	Be It Enacted by the Legislature of the State of Florida:
19
20	Section 1. Section 12 of section 3 of chapter 2001-313,
21	Laws of Florida, is amended to read:
22	Section 12. Authority to fund engineering studies, road
23	improvements, recreational lands.--The Board of Supervisors of
24	the South Indian River Water Control District in Palm Beach
25	County is hereby authorized, empowered, and permitted to expend
26	funds of the District to pay for engineering studies for the
27	purpose of planning a road improvement program, and to pay for
28	the construction, maintenance, improvement, and repair of
29	dedicated roads and road rights-of-way, including the swales
30	thereof, within the District where such construction,
31	maintenance, improvement, and repair is not performed by other
32	governmental bodies and to levy special assessments to acquire,
33	construct, and maintain said improvements on the basis of
34	parcels benefited rather than acres benefited for said purposes.
35	The Board of Supervisors of the South Indian River Water Control
36	District is further authorized, empowered, and permitted to
37	expend funds of the District to pay for engineering studies for
38	the purpose of planning facilities to provide potable water
39	distribution and wastewater collection systems to those lands
40	lying East of Canal 18 of the South Florida Water Management
41	District, and to the Northeast Quarter (NE 1/4) of the Northeast
42	Quarter (NE 1/4) plus the North one-half (N 1/2) of the North
43	one-half (N 1/2) of the Southeast Quarter (SE 1/4) of the
44	Northeast Quarter (NE 1/4) of Section 1, Township 41 South,
45	Range 41 East, in Palm Beach County, in cooperation with the
46	Town of Jupiter and the Loxahatchee River Environmental Control
47	District, and to pay for the construction, maintenance,
48	improvement, and repair of those facilities where such
49	construction, maintenance, improvement, and repair is not
50	performed by other governmental bodies, and to levy special
51	assessments, on the basis of parcels or front footage benefited,
52	acres benefited or other lawful basis, for said purposes, and to
53	transfer said facilities to the Town of Jupiter and the
54	Loxahatchee River Environmental Control District for operation
55	and maintenance. The Board of Supervisors of the South Indian
56	River Water Control District is further authorized to hold,
57	control, acquire by donation or purchase,receiveand maintain
58	real and personal property for recreational purposes for land
59	within the District lying East of Canal 18 of the South Florida
60	Water Management District only, and to make it available for the
61	use of the landowners. The Board of Supervisors is authorized
62	to expend funds of the District to pay for the maintenance of
63	such property, the cost of which shall be borne by the
64	landowners owning land lying East of Canal 18 of the South
65	Florida Water Management District.
66	Section 2. This act shall take effect upon becoming a law.
