1 A bill to be entitled
2 An act relating to the interdistrict transfer
3 and use of water; amending s. 373.2295, F.S.;
4 redefining the term "interdistrict transfer and
5 use"; providing continued effect of agreements
6 between water management districts which were
7 entered into before the effective date of the
8 act; providing an effective date.

10 Be It Enacted by the Legislature of the State of Florida:

12 Section 1. Subsection (1) of section 373.2295, Florida
13 Statutes, is amended to read:
14 373.2295 Interdistrict transfers of groundwater.--
15 (1) As used in this section, the term "interdistrict
16 transfer and use" means a consumptive water use that which
17 involves the withdrawal of groundwater from a point within one
18 water management district for use outside the boundaries of
19 that district, but does not include a withdrawal and use
20 within the same county.
21 Section 2. Any agreement between water management
22 districts which was entered into before the effective date of
23 this act pursuant to section 373.046, Florida Statutes,
24 authorizing the issuance of permits for the interdistrict
25 withdrawal and use of water within a county shall continue in
26 effect until otherwise rescinded.
27 Section 3. This act shall take effect upon becoming a
28 law.

COMMITTEE SUBSTITUTE FOR
2 Senate Bill 554

4 The committee substitute provides that the term "interdistrict
transfer and use" for the withdrawal of groundwater does not
5 include a withdrawal and use within the same county. This will
allow utilities that have wellfields in two or more water
6 management districts to obtain a consumptive use permit from
one water management district subject to an agreement with the
7 other affected water management districts.
